Will Politics KILL all the SHORT SALES? Come Look in my Crystal Ball

When you look into your "Crystal Ball", what do you see regarding SHORT SALES for 2013? A year ago on January 2,2012 I wrote about a troubling trend with Short Sale here in the Manchester NH area. Inexperienced agents are pouring gasoline on the SHORT SALE fire that is burning through America. Now that we are end of the 2012, Short Sales are poised for a MAJOR CHANGE.

When the clock strikes 2013 the law that automatically forgives the amount left over from what a person owes and what a home is sold for during a Short Sale will expire. 

Home Owners who choose to sell through a Short Sale could be help responsible for the taxes on the amount of that forgiven debt. 

In the beginning of 2012 I wrote about the troubling fact that agents who are NOT experienced with Short Sales are taking Short Sale Listings.

What is the most troubling is Home Owners have NOT learned how big of a mistake this is and continue to list with both "OUT OF TOWN" agents and Agent who have no to little experience in listing,k negotiating and selling homes through a Short Sale.

I have heard sellers ask out loud "WHAT DOES IT MATTER THAT MY LISTING AGENT IS INEXPERIENCED?" 

With a Short Sale you usually only have 1 chance at getting submitted and approved. If you are behind in your mortgage the result is often FORECLOSURE for those who choose these inexperienced or Out of town agents.

In 2013 it will have a much HARDER REALITY that if in the rare occasion your short sale is approved. You may be stuck on the hook for tens of thousand of dollars to the IRS if your sale is not negotiated properly.

ALL HOME OWNERS SHOULD KNOW that all agents are not created equal, so your choice in agents is one of the most important steps.

THE BEST TIPS WHEN CHOOSING AN AGENT: You will want to hire a LISTING AGENT who is FULL TIME and WELL EXPERIENCED with your type of home and with the area your property is located in.

a. Why FULL TIME: You should choose a Full Time Agent because their sole job and focus should be on Selling Homes. The key to home sales is being able to be available in that short notice to take care of, guide and assist the seller through EACH step fo the SHORT SALE Selling process. 

b. Why FULL SERVICE: With discount brokers you may get discount services. Nothing beats a full service marketing program working to market your home, attract potential buyers and get your home sold. A Short Sale requires time and patience where a discount broker could offer limited services.

c. Are they LOCAL? One of the biggest mistakes is when Home Owners hire out of town and even out of state agents to handle their sale. You want and NEED an agent that is Local, who knows your town/city, knows your neighborhood and are close by to be there on short notice to offer the additional time and work needed to make Short Sales work. 

IN CONCLUSION The biggest problems start with the Listing of a short sale. Sellers need to be very careful when choosing an agent. Stay away from agents and companies who are out of state or out of town. Big flashy TV commercials from MA often scoop up NH residents into thinking that is best for them to use an out of state company. You may only have one chance to get your short sale listed and approved. There are no second chances if you choose the wrong company based on promises they can not possibly keep.

Hi Scott - The stakes keep getting higher, and if this change goes through at the beginning of next year, it's going to create a lot of pain and confusion. Anyone thinking about short sales now really needs to listen to your advice.

Listing your short sale with an agent who doesn't know the ropes is like going to the local GP for heart surgery. The difference being that the local GP just wouldn't attempt it, but thousands of inexperienced agents are willing to go ahead and list those short sales, even knowing that they don't know how to get them closed.
