Do you contribute to "Problem Prior To Close Conditions?"

At our weekly sales meeting, CT Hancock our NW Austin Coldwell Banker Mortgage Loan officer, brought up three important “problem prior to close conditions” we can ward off before they become insurmountable!

 

1. Do not write in the contract repair items: Put them on an Amendment after inspections are done. This opens the door for underwriters to examine repairs and they may have them added to the appraisal, which would need to be re-certified after repairs are completed.

 

2. Do not turn in the seller’s disclosure with the contract to the lender: This again opens up unneeded underwriting scrutiny.


3. Do not add non Realty items to the contract: For example asking for the refrigerator and washer and dryer. In Texas these items are considered personal property. Create a separate bill of sale for items between the seller and buyer. This can cause problems with appraisals and again opens the door to the underwriter for additional examination.

 

Conditions to close should be kept to a minimum. Agents need to be aware of what issues can cause problems and how to avoid these costly mistakes. If you want a smooth transaction, keep the contracts simple! Don’t muddy the waters.

Here in Florida, many sellers will sell furniture or add "Turnkey" I write furniture up on addendum, releasing both agents and brokers from responsibility for the purchase of furnishing. That this is a contract between sellers and buyer. I don't want to purchase a TV or anything else the sellers might take..Thanks for the post!

A truly great reminder. I can't tell you over the decades the number of deals that hung on this item. The most expensive house I ever sold was a mansion with a large guest house and a cottage used as an office by the owner. The cottage had a pot belly stove from the owners great grandparents original home. The seller never said a thing about it's importance but the way it was installed made it part of the real estate.

You could buy one for $25 at an antique store and we could have switched it prior to listing for sale if I had know. The buyer was holding out for large bucks to give it up. So I switched it and had the buyer and his agent come by and pointed to the replacement and said do you really want to blow this deal over this, you can buy another for $25 and have it installed for another $25 I'll give you a hundred bucks right now if we can remove this one. Buyer said make it $3,000 and we have a deal. I said it isn't worth that to me and I'm sure the sellers will just let it go. I am sure they thought you would understand and it would be no big deal but you win, it is not worth going to court over. I took a wax crayon an wrote on it this stove stays with the property and dated and initialed it and I had the buyer and agent do the same. The buyers agent whispered to me on the way out this guy is the biggest jerk I ever worked with.

About 4 years later the buyer and his company got into trouble and were selling the house, the other agent in the deal now had a seller instead of a buyer and I previewed the property at a brokers open and there sat that stove with the date and initials still on it. I guess the guy wanted to savor the victory. Almost felt like telling him he didn't win anything but I kept my mouth shut. I did ask the agent if he would ask the seller if he would now sell the stove but the seller responded yeah for $5,000. Guess he knew my client was now very rich and might pay the big bucks he tried for before.
