When I started blogging in March of 2007 (disclaimer:  I am NOT stating this, and if anyone sues me please note that I am not stating this "for the record"), I did not know who or what a Redfin was;  understand that I am a east coast boy (clarification:  actually, Ohio but I now reside in sunny South Beach).  I did not know what a Zillow was (sorry, David G. from Zillow) or for that matter even a Trulia (Dear Trulia, I'm not slighting you by not mentioning some fabulous blogosphere celebrity, please feel free to let me know who your front man/woman is in the comments.  Thank you.).

I thought a "transparency" was something my fifth grade teacher put on the overhead to teach us math. (Whew! I'm thankful that "transparency" is a word, because I'm sure an attorney would find "transparency" and engage him/her as a client and sue me for something, I'm sure).

I did not know what "disintermediation" was.  I'm so thankful that Pat Kitano is a liberal  (disclaimer: because I am an artist, I am taking a little artist freedom--so just go with me here.  PAT, DON'T SUE ME).  I think Pat likes me-so I'm sure he'll let go of the FACT that I, infact, did not know what "disintermediation" was when I became a blogger (sometime in the last 12 months, but I am not committing to a date).  BAD BLOGGER

I used to get so annoyed with AR and all the moderators here because anytime ANYONE mentioned the following words:

REDFIN, ZILLOW, TRULIA, DISINTERMEDIATION, TRANSPARENCY, that Kelman guy (again, east coast guy here), Web 2.0, WIDGETS, TLW, BB, LENN HARLEY--BAM:  FEATURED POST!

So I have to deliver the bad news to all the above Active Rain "slam dunk" featured post subjects:

I had noticed these posts from a Realtor in Florida for the past year on Wordpress. Each post starts off with a disclaimer to the effect of this is not advice,these may not be actual figures, this is just for entertainment. She then would proceed with her listing or some market information. What once was weird, is now gold. It is a sorry state if we cannot give out any information, without disclaiming it.

It is scary... We are all afraid to say anything!  I feel that it prevents honesty with clients...  Some of it is good... we dont have agents out there spewing inaccurate information (most of the time) but on the other hand it is time consuming and causes a lot of delays when consumers ask questions and we cant answer right there and then to the best of our ability because we are afraid of being sued...

I just dont get it!

My first blog I had a huge disclaimer for a time... crazy big.  I did not want to explain to my manager or brokerage what a blog is but I did not want to get them in trouble or get fired for blogging.

Found one... it was February 2006 and I had started in August 2005, so I was too clueless to use a disclaimer at first... and have stopped using one since.  I mixed together disclaimers from MLS and other places to make this mess up:

Hi Kevin -Great post and really true...disclaimers are very important...love your humor......you are right...its time for topic change for 2008...

I placed a disclaimer on my posts...but I am sure it is not enough....I did that when I had an incident on the rain....the famous words that were thrown around....Malicious Intent...I said it once I will say it again...many people sure have all kinds of guts behind that keyboard...never understood it...Virtual guts...and in my mind...now you have it in print....evidence...to me if you are not willing to say it to their face...your virtual guts can indeed backfire...

Malicious Intent....hmmmm....liable.....hmmmmm....code of ethics....the golden rule...

I know of agents who lost business because someone blogged negative about them....I know agents who spell out transactions on line...is that right??????  I know agents...who think their humor is entertaining...to only offend some consumers....this is no game in life...this is no free for all....this is real estate.....24/7 we have a license to prove it!  

Wouldn't just be ez to mind our manners??????

I just had a incident where we had a law change....interpretation...mine...and I was wrong...I went back and verified the facts....in the end...I ended with an apology....and better yet...a new friend....and a clear conscious. 

I knew this day would come...where a disclaimer...may in fact save your hide....great post!

Someone can always try using something designed for one purpose and make it relate or apply to another!

Also it is a good way to make sure the intended use is clear in a users mind.  You can sue for any reason, but that don't mean you willwin, but you may waste my time and cause me to spend some $$$.

Then I have to sue you back if I want to recapture my cost and expenses to defend myself.  A vicious cycle that lawyers feast upon.

Great maybe the "transparency" buzzword will go away... and will be replaced with disclaimer and disclosure.  But I think even though you disclaim whatever you write... There still has to be some accuracy and truth in your findings, especially if your are going to stated something as a fact. Granted the issue that is prompting our new buzzword, there was some misleading information on both sides...

While we are in the sharing mode... this is what I have on my about me page.  I disclaim and disclose.

Kevin- I have a different strategy. Just make sure that a handful of your clients (who love you and will protect you.) are the biggest meanest most expensive attorneys known to man.  My lawyer can beat up your lawyer!  I mean, really, what kind of press are you going to get with some little disclosure..

Nice post Kevin, so what you are is saying is, your not one of those Realtors who, when I call to confirm the details of a sale hides behind a canned statement. I love the one hear in South Florida, "our Attorney, advises us not to give any details of the transaction to an appraiser"!!! To be fair, I'd say 75% of the Realtors I've had dealing with have been very good to deal with, the other 25% that a whole other story. I'm sure the same could be said, about the people in my field.

Feel free to sue the crap out of me, because that is about all you can get.  It will certainly cost you more than you could EVER hope to recover, and the only people to really win will be the lawyers you hire.  Although, it is possible that the celebrity status from the high profile lawsuit will increase my business... but you can be sure that my lawyer and accountant will figure out a way to shield that business from you.  So, save your money and let's try to use the contreversy to both our advantages... and leave the lawyers out in the cold.

I LOVED it!  But I'm pretty sure they've abandoned that language.

Kevin - yep, we noticed the feature code words too, though we get quite a kick out of BB and Billie. Sometimes we get featured, but I don't write for it. We try to stay focused on our market in particular, via our outside blog, and if something resonates here from there, well, we certainly like it.

Great post!  Love reading ALL of the opinions of others (both good and bad).  But no, no, no Kevin.  No matter how much you email me, I won't allow you to advertise on my blog.  LOL.  Just kidding!  Disclaimer: The last remark was a joke and only intended to be seen as a casual conversation in the eyes of the law.  

Caroline...great quote!  I'm originally from Chicago and was there to spend the Holidays with my family.  I was telling my sister-in-law about my blog and how much it has grown over the past 7 months.  She said something like "Lucas, you aren't anyone until you get sued".   I never thought any one would actually do so.

I haven't disclosed this anywhere else on the RE.net.  I guess you can say that Kevin has an exclusive about the following information:

(1) Inman News will publish their take on this story tomorrow (Actually, later today since it is after midnight on the East Coast).   

(2) CNN conducted a phone interview with me earlier this afternoon.  If there's enough interest then they will fly down to conduct an on-camera interview with me within the next couple of days.  They realize that bloggers represent a large interest group.  

 I just want to state that i am going to fight this out.  I wish to uphold the rights of bloggers and hope that you will support me along the way.  Kevin....sorry to link to my own blog post but I do feel that others should read my latest blog post to realize that there are a lot of issues that are involved in this case.
