BUYER SUES AGENT

By

this HAS REALLY BEEN A TOPIC THAT BURNS ME UP. SUE HAPPY BUYER IS TRYING TO TAKE ADVANTAGE OF ARE MESSED UP LEAGLE COURT. IT IS JUST LIKE WHEN PEOPLE SUED MICKY D'S FOR SPILLING COFFEE ON THERE SELF. THE HOMELESS SHOULD HAD SUED THE ONES THAT SPILT THE COFFEE FOR WASTING IT!!!! I MEAN A HOME IS WORTH WHAT SOME ONE IS WILLING TO PAY FOR IT. i MEAN I HAVE SOLD HOMES THAT I WOULD NOT OF PAID HALF OF WHAT THE BUYERS WERE WILLING TO PAY BUT TO THEM IT WAS WORTH IT. WHAT MAYBE WORTH IT TO ME MAY NOT TO THEM. WHEN THE BUYERS THAT ARE TRYING TO SUE BOUGHT THERE HOME IT WAS WORTH IT TO THEM BECAUSE THEY WOULD NOT HAVE BOUGHT IT IF IT WAS NOT. AS A REALTOR YOU CAN SEE HOME PRICES GO UP AND DOWN YOU DON'T KNOW WHEN YOU REACHED THE PEAK OF A BOOM UNTIL IT STOPS OR IN THIS CASE HOMES START TO SELL FOR LESS. WHEN WILL THEY STOP NO ONE REALLY KNOWS WHEN WILL THEY START TO RISE WHO KNOWS. THINGS MAY CHANGE AND YOU MAY THINK THEY ARE GOING TO RISE AGAIN AND YOU MAY BE RIGHT BUT YOU STILL DO NOT KNOW FOR SURE. IT IS A EDUCATED GUESS NOT FACT. NOW HERE IS SOMETHING A LITTLE MORE SET AND A KNOWN FACT, YOU BUY A BIG SCREEN TV FOR $4K YOUR HAPPY YOU SAVED FOR 3 MONTHS TO GET THAT ONE. WELL A DAY LATER YOU GO TO THAT STORE TO GET A PLUG AND SEE THE TV YOU BOUGHT ON CLEARANCE FOR 50% OFF NOW FOR $2K. NOW THAT TV YOU BOUGHT AND WERE SO HAPPY WITH THE NIGHT YOU BROUGHT IT HOME YOU HATE AND NOW YOU WANT TO SUE THE SALES PERSON THAT WORKS ON COMMISSION FOR NOT TELLING YOU TO WAIT TILL THE NEXT DAY TO BUY IT? NOW IF THE REALTOR HAD ANY INFLUENCE ON THE APPRAISE THEN I COULD SEE WHERE BOTH AGENT AND APPRAISER SHOULD BE HELD LIABLE. BUT I STILL AM STUCK ON REAL ESTATE BEING WORTH WHAT A BUYER IS WILLING TO PAY FOR IT.  NOW IF THE REALTOR HAD ANYTHING TO DO WITH THE HOME BEING APRAISED HIGHER THEN IT SHOULD HAVE SO A LENDER COULD LEND ON THE HOME THEN I'D SUE HIM AND MAKE IT SO THE REALTOR WOULD NOT BE ABLE TO SELL USED CARS.

Interesting to see how this one plays out.

Chris!

I heard about this too - it left me wondering.

And I don't blame the caps - this is worth shouting about.

Now, tell us how to get around this and what is going on in your area, and with you!

Chris, this does boil my blood as well. I like your point of the TV. So many things could be included. Hell I guess I ought to sue my lawn care care due to the grass growing again. If the case your referencing is the one that was on the today show last week, that buyer will have to bring more than she stated. Being fair she did not present her case well on the facts. I guess her agent was in conspiracy with who shot JFK.

Chris - I understand your anger, thus the all caps - next time though, could you double space it so us old people can read it?

I'm an attorney and I can say that the threshold to sue has gone way beyond that of common sense.  There are reasons to sue and their are sleezy realtors, but give me a break....we need common sense.

That the courts would even here this case is a shame. It will be thrown out but the realtor will still have to defend it. This stinks

It will be very interesting to watch this unfold. I don't think that the claimant has a case, but it's not for me to decide.
