Buyers and Agents Need to Get a C.L.U.E.!

As a real estate broker, I'm surprised by how many agents, including veteran agents, have no idea what a C.L.U.E. Homeseller Disclosure Report is or how it can benefit buyer clients.  If you are representing a buyer, you should request this report with every offer placed on a home.  The C.L.U.E. report is an independent source of information about the insurance claim history for a given property and individual over the most recent five years.  The seller must obtain the report, so the buyer must make it known that they would like the seller to obtain a copy.

Review of the report benefits both the buyer and the real estate broker representing the buyer.  The buyer has the advantage of seeing if any claims have been taken out on a home.  Supplementing the home inspection with the C.L.U.E. report amplifies the buyer's ability to detect potentially costly latent defects, especially for areas that were inaccessible during a home inspection.  It is not a catch-all solution, by any means, since owners do not report or take out a claim on all problems, but the report can reveal major structural defects and problems the owner has cleverly disguised.

In addition, the buyer can detect potential trouble in insuring the home before they make the decision to purchase it.  Home insurance premiums can go up based on the claims tied to the property--despite the purchaser's good risk rating.  A higher premium can also cause a PITI payment to become unaffordable or bump the debt-to-income ratio up to the point where the client no longer qualifies for their preferred mortgage product. 

Furthermore, getting a copy of the report can serve to reduce broker liability because it is another demonstration of due diligence in trying to uncover physical problems of the home.

Don't make an offer without requesting it!

Brett - Interesting post. I think that CLUE reports are a bigger item in certain parts of the country. I've only seen one request in my 18 years in the business in northern Illinois. However I am aware of them through my friends from other parts of the country where insurance is a bigger issue (Texas, California, New Jersey etc...)

We'll probably all be doing them soon.

We always request the Seller Disclosure from the Listing Agent and we're pretty surprised how often the agent doesn't have it.  Some offices don't comply and that's too bad because it really does help the Buyer in making an informed decision as possible.  Thanks for this post - we concur!

We generally request a CLUE report for our buyers as well - but it can sometimes put a real block in the negotiations when the other agent (and seller) don't have a clue about CLUE. No matter how much you explain it to them, and provide them links to how to get it, they just resist the unknown.

 In Arizona the request for the C.L.U.E. report is part of the contract in the disclosure section 4b. lines 134-139. It became so important in Arizona that it was put in the contract. Insurance companies have 60 days post sale to cancell the contract based on past claims of the property. So I agree with you that no contract should be without it. Good heads up post.

Great Post !!  Before I had my Texas Real Estate License, which was before I knew about the CLUE report....my husband and I would just ask our Insurance Agent to check on a home for us to see if any claims had been filed against a specific home that we would purchase. 

Does the C.L.U.E. report cost anything or is it free?

I really like this added tool for homebuyers.I have seen it but its pretty rare herein South West FL. This is a Bookmark and specially with older homes, but not always. Great way to protect your buyers.And yes, it all about reducing liability.

I believe that CLUE reports used to required with purchases, but I think they have been replaced with the 4 page seller's property disclosure, and Lead Base Paint disc, and Siding disclosure. I think that it varies from area to area
