Our  MLS has recently added a few more choices on showing instructions for listings.  And I for one was very Securing a Phoenix home that is listedpleased to see the changes.  Just this week we encountered a situation where an agent took it upon herself to use the lockbox without even looking at the MLS instructions.  My instructions were VERY CLEAR in the MLS agent remarks section.   Listers permission required. I included  instructions on how to contact us and get an immediate response for showing instructions.

 

I was shocked to get an email notice that an agent had shown a listing without calling me. I immediately emailed the agent and asked her why she didn't call me first before showing. We then headed over to the property as fast as we could to make sure the house was secured properly - as there are more than 10 doors into the home and there have been agents that missed one or two doors in the past.  On every showing we make it clear to agents to be hyper-aware to check the doors twice before locking up.

 

You may wonder why we are being so vigilant about showings.  Recently there have been far to many burglaries in the metro area.  Last year one of our properties - armed with an alarm  - was breached. The burglars stole all the brand new stainless steel appliances and somehow they knew the code for the alarm so nobody realized it had happened for a day or two. The police informed us of how much this is happening valley-wide and what the thugs are looking for in many cases. He also gave us excellent tips on how to protect our clients homes as best we could in today's environment.  It didn't used to be the case that we had to be concerned about burglaries at our listings. But it is the reality today. We took their advice and have change our showing practice to protect our clients homes.

 

That evening I did hear back from the agent. She was extremely apologetic and was so sorry she had not called me first. I know she is a newer agent and that didn't understand the seriousness of what she had done or the possible consequences of entering a listing without permission. She told me her clients were so excited about the house as they were driving the neighborhood and 'pushed' her to take a peak in the moment. I asked her if she knew the consequences of her actions.  I knew what the answer would be - because if she had  known she would never had done it in the first place. 

 

 

 MLS Consequences of Breaching Showing Instructions

  • First violation $500.00
  • Second and subsequent violations minimum of $1000.00 up to a maximum of $15,000 and/or a suspension from MLS and/or  Lockbox system for a minimum or 30 days and up to One year.

 

I thought it best to make this a teachable moment for this agent - rather than going the other direction. Had she not been so sincere it would have been a different story.  My guess is she will never make this mistake again.  And my hope is that other Phoenix area agents will read this post and understand the consequences of breaching showing instructions on listings.

AB, I know combo locks aren't as fancy or as secure as the electronics, but they are effective as stopping drive by showings.  If you don't call the showing center, you don't have the combo to get in.

The reason agents do not follow instructions in my area. .they don't subscribe to the MLS and are accessing listing via other "free" means. .where agent to agent communication are cut out. .

In my area, every showing or agent preview must be confirmed - either via a call to the agent or office, or by using Showing Desk.  The showing instructions aren't provided (combo if needed, etc) until the appointment is confirmed.

What drives me nuts though are incorrect or insufficient showing instructions that are provided once an appointment IS confirmed.  Wrong combo codes, no instructions, etc.  Nothing worse than being in front of a home on a day where temps are below 20 trying to get a combo lock to open only to find out the code was changed.

This is why I have some of my Supra electronic lockboxes (such as the one shown in your post) programmed with a CBS (Call Before Showing) code.  No one can access the key in the lockbox without contacting me ahead of time for the code, which is entered prior to the agent's PIN code.  Unfortunately, many agents don't use (or perhaps know about) this feature and, therefore, don't know how to access the ELBX with it so I have to walk them through it step-by-step... but at least I know they can't get in without my knowing about it ahead of time.  I can't help but wonder... did that newbie agent ever realize she could've set off an alarm?  After all, she didn't know whether the house had an alarm and that would've been part of what you would've needed to let her know about had she called.

Jeanee that is amazing to me. The attitude of not caring what the showing instructions are and just do what works for the agent or client is very odd thinking indeed.

 

Nancy exactly - it seems like such a basic expectation and your words speaks volumes:Sellers deserve to have confidence that agents will take seriousy the responsibility that comes with having access to their homes.

Andrea we do the same at times if needed.  It's so easy these days for agents to text, email, call the listing agent to get the showing instructions. There is just no excuse for not learning this the first day of an agents business life.

Nina - the agent got what she deserved. And yes it is annoying when agents insert incorrect codes or forget to update the codes when changed.

Gita - the is a simple courtesy for agents to call if they're going to be seriously late and/or not able to show.  Respectful behavior goes a long LONG way.

Anne she is a newbie that obviously wasn't trained properly.  My guess is she learned her lesson and will never make that mistake.  She would have been in deep trouble had the alarm been on.....  Wow that would be scary watching 'your' soon to be home robbed.  How soon did the police arrive?

Valerie I appreciate knowing who goes in and out of homes - and in a timely manner.  It's the more secure way of keeping home/clients safe.

Scott that is how they should be trained.  Would you want the doors or windows left unlocked if this were your home?  Of course not!!!!  Would you want agent showing up unannounced?  Of course not!!!!

Christina  good for you for looking into what your MLS rules are.  My guess is you're not one of them that would abuse the system.

Bliz there has been a lot of controversy surrounding the combo boxes in our area.  It is considered not the best standard of practice by many.  Since we were flooded with foreclosures most had combo locks which as we know, not monitored or tracked.  Many issues cropped up with homes with combo locks - given out to others.

Fernando - not sure I know what you mean by free means?  Tell me more about that.

Kat oh yes I'd be very upset if I were standing outside a home that I had set up a showing - in 20 below zero weather and then couldn't get in. 

Chuck - exactly.  I didn't know what ours was until I needed the information for teaching a class! 

Leanne she didn't know she might have set off an alarm. If that had been on her mind she would have gone to great lenghts to call the office first!  And yes we can use the CBS code and also we time the boxes as well for certain situations.

It can be very frustrating dealing with agents who don't adhere to the showing instructions.  Another reason to also remove the lockbox after the property is under contract.  You'd be surprised at how often buyers go in to 'measure' without permission and the buyer agent thinks nothing of it.

Oh, there was an agent in my office several years ago who went into the seller's home to bring him copies of some documents (this was before email was the norm).  She was the listing agent.  Walked in, and was attacked by the dog.  The seller was home in the backyard.  The agent sued the homeowner and lost because she didn't let the seller know she was coming.  The dog did what he was supposed to do. Her intentions were good, and she is a very friendly agent, but it was not a pleasant situation.

I'm glad nothing unfortunate happened, and glad you gave the new agent a chance to apologize and learn from the mistake.  We have all been that new agent, right?   As you said, she will never fail to check the showing instructions before going into a property again!

Anna, That agent will never do that again and may pass what she has learned onto other agents! There are still those who want to show off or think they are exempt but hitting them where it hurts is a great deterrent! They better learn it, durn it!

Great post Anna!  Good for you for "teaching" the newer agent what she should do going forward.  I hope this lessens the number of times this happens.  It happened to me too about 2 1/2 years ago when I re-sold my former home.  An agent, her own broker, access my listing without calling - setting off the alarm and my Canadian client was contacted in CANADA! Imagine how mad she was and frustrated I was.  I called the agent and left her a very terse message and sent her an e-mail to never do that again.  I wasn't as patient as you were!

I see agents in our area of violating showing instructions frequently. The usual excuse falls into two categories; proclaimed ignorance of seeing the private notes, or they didn't care and felt they had a right to just go ahead and show the property. As you so rightly point out failure follow showing instructions is an MLS violation and should be reported in most cases.

Ouch!  That's quite a fine for making a blunder.  I do totally understand her mistake.  I've had clients pressure me to see a property when we are out shopping.  Fortunately with a good smart-phone and/or tablet, it's pretty easy to get a hold of someone for a showing.  You were full of grace on this one.  She won't forget it.  8-)

Ms. Anna Banana, with video tours the bad guys can shop for the best homes to break into.  While following showing instructions is very important, of course, why have a normal lockbox on a house under those high risk circumstances?  Show by appointment and increase the brokerage fee if necessary for added security.  As far as I know our MLS does not fine for not following showing instructions.  How does one prove they weren't followed?  Leanne's comment in 26 about CBS is an interesting feature I didn't know about.
