Today I Was Told by BOA My Home is Going into Foreclosure

After three years of filling out loan modification paperwork and sending it in, I was informed via a phone call today from Bank of America that my loan modification was declined on 2/1/13 as I didn't submit all the documents.  Bank of America continues to state this as a reason for declining my loan modifications, but I give them everything they ask for and then have my HUD counselor review it for completeness.  Anyone who knows me knows how organized and detail-oriented I am.  I have a Ph.D. from Columbia University and that required an incredible attention to detail.  I know I submitted all the documents required as I carefully reviewed every request and my HUD counselor, Michael Haynes, of the Neighborhood Housing Services of New Haven reviewed them.

This seems to me to be a bogus excuse.  I think they just don't want to do a loan modification.  Although why BOA would want one more foreclosure in Bridgeport, Connecticut is beyond me.  They aren't going to sell the home for more money than I would pay for it.  I bought this home at the peak of the market in 2005 and paid $400,000.  It is now worth no more than $250,000.  I'm earning a good income now, my income tanked when my husband became ill with pancreatic cancer three years ago and our expenses have been high due to the cost of medications, travel, and treatment.  We also lost his income when he became ill.  We were both in real estate and the market downturn left us with less money at a time when we needed more.

As you know, my husband has Stage IV Pancreatic Cancer and he is getting hospice care in our home.  I haven't told him yet that our home is going into foreclosure.  BOA says to consider a Deed in Lieu of Foreclosure or a short sale and just leave, but my husband wants to spend his final days in his own home.  Is that too much to ask of a big heartless organization?   Probably.   But don't you wonder where all that Mortgage Settlement money went to?  Weren't the lenders supposed to be doing more loan modifications instead of allowing homes to go into foreclosure?  What the heck are they doing with that money anyways???

It makes no sense at all to me, but my hope is that if you would reblog this post that BOA will notice it on social media, reconsider their decision to foreclose, so that I don't have to tell my husband that our home is going into foreclosure.  He's been going through a tough time over the past few weeks and my fear is this will cause him enough stress to push him over the edge emotionally and physically.

I trust in the power of AR to get the word out and in your love and kindness to support me at this time as I try to be strong for my husband.  Thank you.

6 PM 2/9/13 UPDATE:  Two Social Media managers from BOA contacted me today and my case will be sent to their Escalation Team. I will know more on Monday and will post an update in a new post.  Thank you all for taking the time and effort to reblog, Tweet, share on FB, post on Google+, and for your comments/calls/e-mails.  AR may not be a face-to-face group, but we are a community in the true sense of the word - a group of people who care for one another and help each other in their time of need.  Thank you my AR family from the bottom of my heart.

2/11/13 Update:

Three calls today from BOA and I now have one point of contact for dealing with them.  I haven't anything to report yet, except that this time it seems like my loan modification has been fast tracked for priority review.  I will report back as I know more.  I really appreciate your help.  I should know more by the end of the week.  I'll keep you informed.  Thank you so much!  This wouldn't have happened without your efforts. I'm very grateful to my AR friends!  Thank you!

2/16/13 Update:  

BOA told me the loan modification was approved by underwriting and is on its way to Fannie Mae for their approval.  It may take two weeks before we get a response from them. Keeping my fingers crossed!  Thank you!  This wouldn't have happened without the active support of my AR friends. 

2/25/13 Update:

Today a FedEx package arrived from BOA with all the documents to sign for a trial loan modification!  I need to talk to my HUD counselor, but it looks like they really did their best to get me the lowest payment possible.  I told my husband today and he was very relieved.  He's in the hospital right now fighting for his life with a massive infection (they don't know the source of the infection yet).  Tomorrow will be his birthday and it was three years ago tomorrow that he was diagnosed with pancreatic cancer.  This was a wonderful birthday gift.  Please keep him in your prayers for one miracle.  I would like him to return home and feel good enough to celebrate a belated birthday.  I don't want this to be the end, but I know it could be.  You've done so much for me my dear AR friends and I have no right to ask for one more favor, but if you could put him in your prayers for another miracle, I would be very grateful.  I love him so much and it's hard to believe that this could be the end.

3/19/13 Update:

My husband is still in the hospital.  He has been fighting three massive infections and is still on IV antibiotics.  We just celebrated our 8th anniversary yesterday (as much as you can celebrate under these conditions).  Thank you for your prayers.  He did indeed rally and I am hoping he is on the road to coming home, but it's still up and down.   I made my first trial loan modification payment thanks to the power of ActiveRain.  Thank you for helping us get this loan modification.  We should know about the permanent one by July.  I'll keep this post updated.

12/30/13 Update:

Now that this post is listed as one of the top five most commented upon posts of 2013, I should provide an update for those who haven't been following me.  He did come home from the hospital and entered in-home hospice.  He enjoyed seven more weeks of life before he lost his battle with pancreatic cancer.  He was relieved that I had received a permanent loan modification before he died.  He loved our home and I wanted to be able to stay here afterwards because we have so many memories together. 

Real estate has picked up in my area and I had a successful year.  I deeply appreciate my clients who stayed by me through these difficult times.  I never let my clients down, no matter what was going on in my personal life. 

Thank you to everyone in the ActiveRain community who reblogged, Tweeted, Google Plussed, and so much more.  BOA responded right away and thanks to the follow up from the AR community, BOA finally gave me a permanent loan modification just before my husband died.  I'm in awe of how the AR community came to my aid in my time of need.  This an amazing community, a real community, in fact I often call you my "AR family."  Thank you!

Gail, Have you reached out to your Congressional office?  Maybe they could get a better reaction.  Or the local press/TV station?  If ever there was a case where the heart strings would be tugged you've got it.  My last attempt at using social media for BoA was conveniently ignored by them so I think you need bigger guns to help.

Cindy - I've heard of this happening to others with BOA on loan modifications.  I know I crossed every T and dotted every I.  They make the mistakes and the consumer loses their home.  It's not right.

Christine - It is outrageous!  And I'm just one of many as you know.  I won't go down without a fight!

Gail we went through the EXACT same thing.  Finally got a lawyer to get a mod done for us after like 6 tries ourselves with BofA.  It cost us like $1500, but the lawyer getting involved got it done.  I will reblog, too in hopes of getting you some help.  Praying for you and your husband.

Gail, I am so sorry to hear this.  I am wondering if this is another doggone case of the loan mod department NOT communicating with the foreclosure department?  I have not had many short sales, but this was a major problem in two of them.  Each lender department... loan mod and foreclosure... worked totally independently of the other.  No inter-back communication for them.  So, if my seller sent the required documents to their loan-mod department, they should NOT expect that the foreclosure department had any knowledge whatsoever of those documents.

Perhaps this might be the case with your lender, as well.  I sure hope you can work this out.

I have sent what I can send for you, Gail. Chris Ann just sent this to me. In some instances, B of A does want to foreclose. It's certainly within its power and right to foreclose. However, B of A can also postpone the foreclosure for certain circumstances, and I would say this counts as a qualifying circumstance, but I am not a person with any authority. I'm so sorry this is happening. I think all of us might make a difference. Please let us know what happens.

I had great success with that when I kept getting the run around in a client's BoA short sale.  Same story, they kept claiming we din't submit the docs they requested even though I did.  That one eventually closed. I actually had someone from BoA call ME after my tweet!  I've also had success sicking HAFA reps on banks who aren't playing by the rules *cough* Wells Fargo *cough*.  Hang in there and keep documenting everything as I am sure you are already doing.  Let me know what response you get from the tweet.  It took them about a day, but they did get back to me and resolved my issue.

I'm going to use all my networks on your behalf; whatever I can do. As an optician, I hear up close and personal stories of homes going into foreclosure just like yours, and for the same reason.

I spend hours on Zillow, dreaming. I see "foreclosure" istings thick everywhere. What is going on, Banks in America? We're just waiting for you to sell everything to foreign investment, or something? Don't we pay for the largesse given to you from Congress?

Perhaps we need to nationalize the banks, to get our homes and land back into the hands of individuals.

Gail,  We are so sorry to hear this all happening to you.  The circumstance leading up to all of this is just tragic.  Its hard for me to get my head around corporate thinking in these issues.  You're obviously hardworking, responsible and have a unique debilitating circumstance, why a loan modification or some GRACE is not the answer for BofA is beyond me.  Others have already made excellent suggestions and I hope this reaches the ears and heart of those at BofA.  Stay strong, our prayers go out to you, your husband and family.

Gail, I have had excellent results with Tweeting - their damage control team will pick it up immediately, and also with having our Congressman's office call to find out what is going on.  That will escalate the file up the pecking order to someone who can make some decisions.  In your case I think the odds are excellent that you will be able to have your modification attempt reopened and the correct reason it was denied determined.  Or, if they have truly lost docs you already submitted, you'll be able to submit them and have the process play out.  Unfortunately,  I have found that most of my clients who attempt a modification are disqualified by the hardship that caused them to default.  Best of luck to you.

   Sorry to hear of your plight.  We just got told a couple of days ago by Chase that they were turning us down, as well, after three years also.  I'm very familiar with the kind of 'hoops' they've been making you jump through.  I wish we could be of help, but we couldn't even help ourselves in these B.S. modification scams the banks are conducting.

This is an obvious media story-call or email the reporters in your area, especially any who've written lifestyle or front page articles. Sometimes they do this and you just need to call back and re-submit everything. The other thing to check is that all of your signatures are correct and match up with how they are printed on the docs.

A while later I had someone from the executive offices call me and we eventually got it worked out. If you've tried all the conventional methods it can't hurt to go over some heads. My friend who was an agent for a while recently went through this same situation and it took almost 4 years to resolve.  He was denied a modification about 18 months ago.  He took to social media and tweeted BofA and finally started to get somewhere.  As of last week he finally had a modification.  It took him a lot of being vocal.  Let us know if there is anything else we can do to help.  I am going to tweet a link to this article out to BofA and I have never had them not contact me or the party we were tweeting about so I will pray they contact you and help work through a resolution.  Peace and prayers to you!

Gail: First of all I will re-blog this but you need to do this right away:

  • Find your congressman's addresses both locally and in Washington DC.
  • Remember to refer to him/her in his address as: The Honorable such and such
  • Write this story to him---just use this post; this should work.
  • Actual dates Of contact will help if you can remember them or if you have them written down somewhere
  • Locate the Office of the Comptroller of the currency in Washington DC
  • Copy the O.C.C. on your letter to your congressman, address them as: To Whom It May Concern
  • All your information should be as detailed as possible in terms of dates, $ amounts and any person you dealt with
  • Make sure you tell them this is an emergency
  • Send these letters, certified to the local and Washington DC offices of your Congressman and to the OCC in Washington and mark them URGENT MATTER. They have to sign for them so you  will know when they get them

I had a problem in 2010 when I was totally running out of money and the real estate market was dead. I had burned through my retirement money just to pay the mortgage on my house.

I wrote a letter in early 2010 to my Congressman and he notified the O.C.C. about my situation...yours may too but I wouldn't take the chance. My bank was Wells Fargo and they did end up giving me a modification which was meager at best and I have since sold my house and made a little money on it but I would not have been able to continue the mtg the way it was originally and since the market improved here, I got some extra time to get to the other side.

You need to make sure that you are the "squeaky wheel"...DO NOT let them think you will go quietly into the night! It takes perserverance but you should be able to get some satisfaction. There IS money available that  was paid by the tax payers to help you out--you are entitled to get the help you need; the banks already have that money! Even if it just gets you to a better market you will not be sorry if you give it this effort!

Good luck and keep a positive thought--you ARE entitled to peace of mind and a modification!

Gail, wow, a new low for Bank of America. You can do something called a QWR - Qualified Written Request - which is like a forensic audit if your loan, where you write the bank and specifically request all your loan documents. If they cannot produce all of these - and chances are since you have a loan from 2005, they can't do this because documents were omitted or signed improperly, etc. Harris University teaches this as a way to stop a foreclosure in its tracks and many use it right before the court date to stop the foreclosure.

BUT you shouldn't even be receiving this since you have complied with their requests and taken the extra step of verifying with the HUD counselor. A Ph.D? I knew you were extra smart to have your awesome Black Rock blog!!

Will broadcast this everywhere, Twitter G+, Reblog, and pray that this reaches the right people's ears/eyes. 

Also will pray for you and your precious husband during this time. May the Lord comfort you and grant you peace.

An attorney sounds like a stellar option if the price of $1500 is true - you should be able to get the bank to pay that back to you hopefully. They can't give an attorney the run around who knows what they are doing. 

If you are interested in the QWR, you can do a free trial with Harris University and they have all the info on their site. Or do a one month and you can get it all. Or maybe the attorney will know how to do it. It's more than writing a letter to them It has to be to a certain address and with certain language. Hugs and kisses and prayers to you :)

You need to get them involved here...you an also file a complaint against the bank too....go on Google and search for "Complaint against my bank" and see if you can get the forms there....I would do that only if you get no satisfaction from your Congressman/woman and the OCC.

This is the last thing you need to be dealing with under the circumstances.  Call your Congressperson asap, all of their offices, they likely have more than one.  Make sure you get the name of who you talk to, and don't stop calling until you are talking to someone who has a heart you can touch.  I am committed to sharing your post, and your story, this is appalling...

I am so sorry that you are going through this. The Bank has done the same thing to my grandmother. She/We have sent everything in over and over and over again. They even started calling 2-3 times a week where my grandmother told them it was borderline harrassment. All for the same thing - cliaming they didn't receive paper work, saying they were putting the house in foreclosure for her non compliance. My grandmother died last week. She died, fighting FOUR Years for a modification. She's gone now. Sad.

Okay,   I HAVE TO TELL YOU THIS.   A person who I worked with, formerly worked for BOA, and went through all kinds of paperwork, and ended getting tit foreclosed on....  Their office was literally across the street from her, and messed up!  BTW she is now part of a class action lawsuit over this mess.

.....Now, I'll tell you another good one. My neighbor had her home with BOA, formerly Countrywide .   She moved out about 3 + years ago.  She filed for bankruptcy and gave them her house back.  She tried to get a loan modification, but  they told her she had to be in default several months, ..which she wasn't.   So she was hoping the bankruptcy would get rid of the place.  GUESS WHAT, they NEVER foreclosed on her own, and as a result the HOA continued to go after her for pass HOA dues, even though she had put the home into her bankruptcy, and thought it was no longer her responsibility.  

After 2 years of fighting with the HOA, a judged forced the HOA to foreclose on the house to get it our of name. My HOA now owns a house, that should be BOA's.   That's right.   It cost her almost 10,000 bucks to fight the HOA for house she never lived in, but still had the deed in her name.

BOA of now calling her numerous times to claim they would like to work out something because they do not want the house back!  Seriously!  She's been telling these morons she  no longer owns the house.  

So here's what I have to say, ...if they aren't consistent in their foreclosure process, then are they discriminating in terms of debt collection, and as I told my former neighbor,  Don't move just yet! She could have lived here for the last 3 years, rent free because of the BS BOA has messed up on.

Gail - I knew that they will not approve the loan modification. Doesn't matter why, they just wouldn't. It is very common. I do not want to go in speculations why, but this was the reason I wanted to try to organize AR community to get you some relief and, ideally save it from losong, even though I know that this is a tough call.

I know that you have submitted everything they asked for. We do get this crap on many short sales, when we would send everything they ask, and then get a denial claiming they have not received the documents.

Karen - My HUD counselor is in touch with the loan modification people.  They are the ones who keep asking for new paperwork.  It's in foreclosure because they just won't approve a loan modification.

Lyn - Isn't it the Attorney Generals who agreed to the Mortgage Settlement?

Kristen - That's my only hope at this point.  That and the print/television media.  Thank you.

Susan - Thanks we'll take all the prayers we can get at this point.

Elizabeth - If they are going to foreclose it would be nice of them to forestall the foreclosure summons during his time in hospice, but they really should just do a loan modification.  I will definitely keep everyone up-to-date.

Stacey - All that paperwork does take time away from my husband.  It's amazing how much time I've spent over the last three years on loan modification paperwork.

Melissa - It would be the humane thing to do under these circumstances.

Sheila - My senator has been very responsive with phone calls.  There is no need for me to go there.  I prefer to be with my husband right now.

Steve - Logic would suggest that they do a loan modification as I bought at the peak and they could never sell the home for even half of what I paid.  Compassion is out of the question, I suspect.

Scott - Thank you.  My husband could use the prayers right now.  I guess I could too, to have the strength to help him through his illness while fighting foreclosure.

Laura - I go with the flow, but sometimes that flow is to stand up and fight.  I think that's what I'm supposed to do.  There are so many others besides myself in this predicament.

Stacey - BOA and other lenders are going to experience the kind of backlash you are talking about.  Their greed has gone too far.

Ed - I know, and I think our choir is going to make a noise that will be heard in BOA's corporate offices.

Corinne - The CEO's office has a social media group, but they don't do much.  Someone named Steve Fox called me about a year ago from there, but now he doesn't return my calls.

Andrea - I hope something good does come out of this, not just for me, but for others in this same situation.  It's beyond stupid!  It's evil!

Kristine - I've done all I can do.  I've been working on this for three years and now they are going to send the foreclosure summons.

Kathleen - I believe it will be escalated with so many ActiveRainers blogging, Tweeting, etc.  It's a shame that we have to do this to be heard.

John - The really crazy thing is that I have the income to qualify for a loan modification and virtually no debt!

Kathy - I know it is common place.  If I wasn't so obsessive-compulsive, I could believe I missed a bit of paperwork, but my HUD counselor double checked and I triple checked.  Everything they asked for was provided.

Janna - Thank heavens this is a judicial foreclosure state.  I can't imagine they will have a case for not doing a loan modification.  What a shame that the only way to get one is to go to court and have the judge lay down the law on BOA!

John - I'm so sorry.  Are you in a judicial foreclosure state?  In Connecticut, the judge is effective 80% of the time in helping to get a loan modification approved.  What did the lenders do with that Mortgage Settlement money????  Why can't people get loan modifications?

Lynn - I'm so tired right now.  After helping my mom and then my dad through the end of their lives while dealing with my husband's illness.  I don't feel amazing, but I will fight the good fight, because I hate unfairness.

Michelle - The media will pick this up.  

Sheri - I was contacted by Steve Fox of BOA about a year ago, but he doesn't even return my phone calls now.  I think they assume that these things appear on social media and is then forgotten.  

Lynn - I'm a pretty strong person and I will put up a good fight, but it's wonderful to have my AR friends by my side helping me.  Without that, I'm just one small person and BOA wouldn't care.

Sharon - I did the QWR and I've got the documents.  They refiled documents twice in Land Records after that to get all their ducks in a row for a foreclosure.  In my state there is unfortunately a law on the books that states that the Servicer doesn't need produce the note or prove the accuracy of their records.  It's an unfair law and I've tried to get it removed, but it keeps getting tabled in committee.

Jon - Well, it's not a waste of words to share my plight with my AR friends who give me encouragement and support given my situation with my husband.

JeFreda - We need to start a movement!  There are too many of us in this situation and they have all that money from the Mortgage Settlement and aren't using it to help people get loan modifications.  I'm so sorry you are going through this as well.

Paula - I looked at my notes and apparently I did send a letter to the OCC at least a year ago and I did file a complaint against the bank, but I heard nothing back.  That was at least two years ago.

Shame on BOA - they are not listening to the customers that are trying, and want to save their homes. They continually ask for the same documents, then claim they were never received.  After hearing Gail's story, and her desire to work with them, they should not be making her jump through hoops, they should be saying, "how can we help".

 

The business side of me says BOA - why would you not try and make this mod work - you will make money off all your fees and interest for many years, and you would have a loyal customer that appreciated you working with her in a time of need.

 

Gail, I will repost your blog everywhere in the hopes that someone will hear your story and help. Please know that my thoughts and prayers are with you and your husband during this difficult time.

It amazes me that the banks cannot seem to make these loan modifications happen when one of the reasons they were bailed out was so that they could work with their customers and help them keep their homes. Sadly this is impacting you at a time when a loan modification would make so much difference for everyone include a good public relations story for BOA. I hope they hear these messages.

This is a sin, and a very sad commentary on the state of the banking industry and the continued failure on their part to do anything that remotely resembles aid to the consumer. The loan mod system is a total  joke, and this is just one more example. I, too, wll reblog this and do what I can to help spread the word.

The exact same thing happened to me, here in Sparks, NV. My lawyer & I took them to Justice Court and they got off on a technicality. The truth is… BofA wants to foreclose on people. Many loans start from smaller banks before BofA buys them up. They come with insurance backed by the government. So they are going to get their $400,000 from your loan, PLUS the amount it auctions for. They are blatantly screwing people out of their homes. Here is my story...

I am your average American girl. Born & raised in the Bay Area, I moved to Sparks Nevada to buy a home. I relocated and found a job after a couple of months. When the economy started to crash, my hours at wor
k were cut back. I also found out that my husband was cheating on me with a co-worker while still married to his old wife in California. Naturally, I had the marriage voided due to Bigamy. Times were tough and I couldn’t afford my $2100/mo loan payment. I turned to Bank of America for a loan modification. Lowering my payments would help me keep my house and move on with my life. I applied for the first modification and was accepted. I faxed W2’s, paycheck stubs, tax returns, a hardship letter, bank statements, everything the bank asked me to do. I completed my 3 Trial Payments with them. I waited and waited for a response about the Modification and every time I called, they told me it was “in review” or “in underwriting”. Several weeks later, I was told the modification as accepted and the final papers would be mailed Fed-X for me to sign & return. I waited again, following up with several departments, only to be told the status was “in review”. B of A representatives told me to wait a week longer for the papers to show up. A week went by and the papers never showed. I called to have them re-sent. The lady told me that the modification was cancelled because I failed to return the signed documents. I asked again for a copy of the papers and I was informed that I would have to start the long process all over again. Sitting at my desk at work, I cried. It was such a frustrating process, being transferred from the Hope Department, The Home Retention Department, Customer Service Department, etc. etc. Meanwhile, I was paying as much as I could toward the mortgage. The next thing I know, they stopped talking my payments. My house was officially in foreclosure status. I was devastated. I started the entire Loan Mod process again. The story doesn’t end...it only gets better….
I resubmitted all of my financial info. I mailed them and faxed them. This time, things were different. I was going to document every conversation and date with B of A. Pay close attention to 09-13-10. Here is the time-line of events:

04-06-10 Loan Mo
d trial payment $1910.62 Completed 3 trial payments
?? Loan Mod Accepted, Fed-X envelope never showed up. Was informed Mod was cancelled/have to start over.
05-18-10 Verbally re-submitted financials missing from their computers
05-23-10 Faxed all financials
05-25-10 Called to verify receipt of faxed financials. Talked to Lauren. Papers received. They are in review. 
Was told to call in 2 weeks to check status.
06-04-10 Referred to MHA (Making Homes Affordable) Dept. 1-888-325-6435 
MHA has NO PAPERS or info in their system. I was referred to HOPE Dept. 1-877-202-2830
?? Mailed all docs/financials in supplied Fed-X envelope
06-15-10 Called for status: In work-out review, told to call in 2 weeks
07-22-10 Called for status: Referred to Home Retention Dept. 888-325-6435
Called Home Retention. Doc’s received 07-14-10. 
Message on my home machine: They said Doc’s are incomplete. They need my 2009 Tax Returns. 
Loan pushed into foreclosure.
?? Called about missing Tax Returns. They have them in the computer and will Excelerate the Loan Mod. (31684 Order I.D. #)
Informed me that a Sale Date was assigned.
07-27-10 Talked to Dana. Advised me to call Foreclosure Postponement Dept. Called them. They put in a request to postpone the Sale date
07-30-10 Called Postponement dept again. Postponement from the 27th is not in the computer! Agent will Re-request it.
08-10-10 Called for status on Postponement: Agent advised they are still waiting on Fanny Mae. No postponement.
Also called MHA Dept. to check status of modification. I was transferred to the Foreclosure Dept. 
They said on 08-09-10 Docs were assigned to Underwriting for review.
08-12-13 Called Postponement Dept for Status: till no postponement, was told that sometimes the investors wait until the last minute.
08-13-10 Called for Status: Talked to Floyd: Postponement approved! Was advised the postponement is only good for 30 days.
I need to call before sale date to postpone again. Sale date suspended until 09-13-10
08-16-10 Called for Loan Mod. Status: It’s in Underwriting, was told to wait.
08-26-10 Called for Loan Mod. Status: Same.
09-07-10 Called for Loan Mod. Status: Girl said it was in suspense. Nothing being done. She will expedite the Loan Mod.
Was transferred to the Postponement Dept. to suspend the Sale Date. Agent put in for a postponement. Told to call 09-13-10
09-12-10 Called to check status of postponement: still no postponement. Loan Mod. needed to be expedited again.
09-13-10 House sold. Purchased by auction on front steps of court house: Buyer James Zaczheo
09-15-10 Called to ask about relocation assistance: Talked to Angela: said there are notes in the computer that will benefit me.
She placed me on hold because she needed to talk to the Foreclosure Dept. 
I was transferred to Ray in Foreclosure. He advised me that the postponement was approved on 09-14-10. 
He admitted this was a huge mistake by BofA and would escalate this to a Team Manager. He said the account is still being 
reviewed for a modification and they will try to reverse the sale date. He said the Manager will put notes in the computer by 9pm 
telling me what to do. I should call the next day.
09-16-10 Called the number I was given 1-800-262-4218. Agent had no info
I was transferred to Home Retention Dept. 1-866-422-5871 agent has no info
I was transferred to Foreclosure Dept 1-888-284-4978 talked to Latrinda she had no info
I was transferred to REO Dept. 805-520-5207 voicemail said “mailbox is full” and transferred me back to General BofA #
Called in Afternoon: Talked to Sue. She told me she could see the postponement was sent 3 times. Transcripts go back as far as 
March 2009. I could call 1-800-669-6607 and get transcripts faxed to me of all notes in my file. 
She advised: There are no new notes from a Team manager. She could not tell me what to do.
09-17-10 Talked to Tenishia. She advised I would have to fax a letter requesting the transcripts to the legal dept.
My house was gone! I was devastated and angry. How could a company do this to people? It’s happening all over the place. I must also add the very important fact that every representative I talked to assured me while in a Modification, my house would not be sold or foreclosed. This was a blatant promise and I felt the misrepresented themselves on several occasions. The only thing I could do was to consult an Attorney. They agreed to take on my case on a contingency basis. Meaning, if we don’t win, they don’t get paid. All the correct papers were filed, and it was another waiting game. We had to wait for them to respond. We had to wait for them to file an opposition. We had to wait to get into court. The day came for us to argue against the dismissal of the case. We had multiple claims against them from Misrepresentation to Gross Negligence. The judge sat on his bench completely devoid of any emotion or insight. He threw the case out because of a 90 day statute. We had 90 days to file this modification in court and had gone over that time. I guess he didn’t stop and realize that one of our many claims was for misrepresentation (being lied to) and the statute on that is 2 years. He didn’t care. The 2 cases before mine were also thrown out. I tell ya people, they are trying to get these things cleared out of the court system as fast as they can with no regard to the fact that this major company is lying and cheating people out of their dreams. My lawyer and I walked out of that court room with our heads down. During his statement, the judge admitted we had an excellent case, however we had gone over 90 days. (For that ONE claim). I have lost all faith in our Justice system. I have been let down by a system that says they want to help people. Betrayed by a powerful company that is above the law. I had agreed to stay quiet about this matter with Bank of America during litigation, however now my silence is broken. I am an average American girl who had hopes and dreams that were destroyed by a corrupt company. I can only pray that people will pull their money out of that bank and transfer loans to ethical lenders. I don’t want this to happen to anyone and it’s time that Bank of America become accountable for their actions. Thank you for reading my story.

Gail, you and your husband are in my prayers, I can't imagine the stress you are feeling right now. I have re-blogged your original post with the following introduction:

When a large corporation like BOA decides to deal unfairly with one of it's customers it may seem like there isn't much that can be done about it but that's not true.

There is strength in numbers and even corporations as morally bankrupt as BOA don't like bad press and they don't like loosing customers. I closed by business account at BOA more than three years ago but that's a story for another blog post.

I encourage you to re-blog Gail's original post. Share her original post by tweeting a link or sharing it on your Facebook page, Google+, LinkedIn and any other social media you can think of. We may not be able to help all of the people that BOA has dealt with unfairly but we can help Gail with a few keystrokes and a few mouse clicks... that's not too much to ask is it?

I have heard about these banks that took the bail outs and now will not do the modifications. Clearly it is more profitable for them to foreclose.

This on top of the stress of your husband's illness. They say we are never given more than we can handle but combinations like this make you wonder. It seems weak, but hang in there. My mantra in these moments is, "this too shall pass".

Hi Gail. So sorry this all happening to you. I know it doesn't help but one reason lenders rarely modify loans is because they make more money via short sale or foreclosure. Why? Mortgage insurance. MI does not pay out on a loan mod. Foreclosure or short sale pays out 20% to 30% of the original mortgage amount.

BOA has the power to help...they are just opting not to.

I can't imagine how you are holding up. You must be frazzled and on your last nerve, tired, at your witts end knowing you must do it all alone. Fighting the bank, protecting your home, your husband and run a business. Don't move. The worst thing that could happen is you move and that home you love is left to the elements, vacant and then you would have to foot the bill later. STAY PUT.

From CBS MoneyWatch on 9/6/2012 Banks Stick to Short Sales in $25 Billion Settlement Relief...

Of the $10.6 billion paid out so far, about $8.7 billion has gone to short sales. Only about $1 billion combined has gone toward mortgage modifications that reduce loan balances and refinances.

 

Of the five banks, JPMorgan Chase has spent the most money on first-mortgage principal reduction at $367 million, followed by Wells Fargo with $216.9 million, Ally at $111.3 million and Citibank with $54.3 million.

 

As for Bank of America: The company hasn't spent a dime on first-mortgage modifications that reduce loan balances for borrowers or on refinancing mortgages. Instead, they have spent $4.8 billion -- the most of the five banks -- on short sales.

Hi Ms. Sussie. I just read your post about the lady who was being denied a loan modification from her bank. I almost lost my home for the same reason. We were hit hard by Hurricane Ike and as caterers, lost all of our income for the last quarter of 2008. I won't go into all of the details but reading her story was exactly like what I went through. I tried to post on this blog to tell her what happened to me but it won't let me unless I sign up on their site and I am not a realtor. Can you post to this blog? We have our mortgage through Chase Bank and they are horrible. I fought with them for 3 long years and even went into foreclosure.

I had a friend tell me that she had a similar situation and she contacted our state representative, Kay Bailey Hutchinson. I thought what do I have to lose so I contacted her office and they had me send in a short summary of what had happened to us and the paperwork that I had filed over and over with the bank. Chase put my foreclosure on hold and almost a month to the day, I got my loan modification. Sussie, Chase had me make interim loan payments that were supposed to be for only 3 months that dragged into 1 1/2 years. All of that money went into a suspense account so we continued to accrue penalties and interest. When they finally posted these payments, almost all of it went to the penalties and interest. After being in this house for 15 years, we now owe almost as much as we did when we first got the mortgage. Please tell her to contact her state representative and get them involved. I was so amazed that it helped me and I don't think I would have gotten the loan modification if I hadn't gotten her involved. I am so heartsick for this lady and her dying husband. How heartless can a bank be!!! I did not want to post this on your post because we haven't told a lot of people what we went through and feel ashamed that we had our house in foreclosure. I think that is why so many people are losing their homes because they feel ashamed that they are in this place in the first place. Please message me back so that I know that you got this personal message. I want this lady to have every fighting chance that she can. I don't think it will help to just do the blog. I think getting someone with clot like our state rep. to contact them is the only way to go. I have the highest regard for Senator Kay BH. She will always have my undying gratitude.

Gail, I've heard  horror story after horror story about BOA.  Your AR family gives you their support but I think you need to go to your Congress person and have a dialogue-this is outrageous and perhaps they can have an impat.

 I feel so bad for her. That is exactly what we went through. I kept resending documents they claim they never received. Next phone call they would use a different excuse like the policy requirements have changed. It went on for almost two years until Bruce got an attorney involved. But we had to agree to a short sale - which did take 7 months from the time the offer was made.  It is a disgrace how BOA is handling these cases. They are getting their money from the government so they don't care who gets displaced.

I tried to post the following on BOA's Google Plus page.  HOWEVER, they do not allow anyone to comment on their posts.  Sad that a company would be involved in Social Media and doesn't allow anyone to be social or interact.  It shows there is something wrong with their company.

 

Please read this article about your company.  This is a real estate broker who has a husband dying of cancer and was trying to modify her loan.  She was denied on a technicality that did not seem plausible.  This has created outrage among the real estate community , resulting in over 100 reblogs on Active Rain, over 400 shares on facebook and countless tweets and shares on Google Plus.

I'm hoping that someone at Bank of America will take notice and help her with her case.  Thank you.

Gail, I know, intimately what you are going through with the untenable process of trying to get a loan modification.  To have suffered a life situation as difficult as yours without all the extra stress of the system, is enough to take all hope away, at a time when you need it more than ever.  

You are incredibly brave to bring your problem to the world of AR and all the good folks who form a column of faith and determination behind you, keeping you rock solid in your resolve.  When life threw me into a similar situation, after fighting to keep my head above water, I finally gave up, and retreated from everything and everybody.  It was with a stroke of luck and the good advice of my brother that I managed, at the last moment to avoid foreclosure, but at a huge cost.

You've gotten some wonderful advice here and I'm not surprised.  What a stalwart group these ActiveRainers are.  I will reblog, and add my prayers to the long line of those that preceded me.  God bless you both.

Lots of thoughts for you:

1)  DId you get an actual foreclosure DATE notice or just the "empty threat" letters they send?  If you do not have a foreclosure date you should still be ok.

2)  Try the Bank of America Twitter team (they can be VERY resposnive):

or call their Twitter Team directly - 855-834-5401

3)  Find out who the Investor is on the loan and contact THEM directly - the Investor on the loan is the entity that actually funded your mortgage, Fannie, Freddie, the Gail Robinson Pension Fund, etc.  These are the people that are actually being affected financially by the non-sense B of A is putting you through.  Contact THEM and watch how quickly your calls get returned and your situation is resolved.

4)  Their are also numerous places you can file formal complaints again B of A, 2 of the best:
OTS (Office of Thrift Supervision)
and
The OTC (Office Of The Comptroller of the Currency)

are GREAT sources.  They oversee loan Servicers like B of A and get VERY involved when things like this go on.  If hte higher ups at B of A know you have filed a formal complaint against them, again they suddenly take a STRONG interest in helping you.

Gail, if there is any way with the contacts and connections that I have to help you with this problem I will put them to use. This situation with Bank of America is a signal into how flawed the loan modification process really is. I've seen the same problem with short sales as well.

You have a strong community here backing you up and getting the word out. I would be willing to bet that the negative media backlash will have a role in getting you a positive outcome.

Please feel free to post your own horror stories of BOA loan modifications.  This isn't just about me or my situation.  As we can see from the news, BOA does not want to do loan modifications despite the $25 Billion Settlement Relief.  My mortgage was a Countrywide loan and the settlement was created to help people like me who bought at the peak of the market and need to modify their loans.  BOA is recommending I do a short-sale or Deed in Lieu of Foreclosure so someone else can live in my home for a fraction of what I paid.   Let's keep people in their own homes.  We've had enough short sales and foreclosures on the market!

In any case, if they are going to foreclose, all I ask is that they wait a year before sending the foreclosure summons given my husband's situation.  I can't deal with my husband's end of life situation and a case in foreclosure court at the same time.  That's too much to ask of anyone!

We in the West have seen this and blogged about it for years. This is normal not unique. California found it to so abusive they passed a law that you cannot have loan modifications and foreclosure going on at the sametime.

I am so sorry for your situation.  How do we really get the public to know what B of A is doing.  They do not make sense.  I will pray for an answer for you and your husband.

I totally understand what you are going for.  I have been trying to get a loan modification on one of my homes and have been denied by BOA numerous times.  It falls under one of the settlement suits and yet despite the fact that they kept sending me packages insisting I would qualify once I actually applied they came back with a decision within less than a week that I was denied - there there were no way they could modifiy it and they sent the decision to where I told them not to send it and when I requested another copy they never sent it so I could not reapply during the appeal period!

BOA has never been able to make a decision in less than a week on any type of process - short sale or other loan modifications but the one that entailed getting money from a settlement or an actual principal foregiveness they were able to make that decision fast!

Report them to the CFPB, send a registered letter to their CEO, call the local TV and radio station, tweet, facebook, have anyone you know that has an account with them pull it out of their bank.  Talk to your local state representative and senator. 

They are pushing the short sale or DIL because they can get rid of the loan that they don't have the proper paperwork for.  Get an attorney to do a QWR asking for the actual loan paperwork and go after them for the mistakes.  It is well known that Countrywide scanned the loan papers and did not keep the originals as part of their efficiency...but you need the originals, not copies, not scans to foreclose....

Make noise and keep the spotlight on them.  My prayers and thoughts are with you and may you get the loan modification you desere.  I am sending you a number to call that might help.

Gail, my horror stories are with Chase (originally Countrywide loan) but recently they just approved us for a principal reduction, modifying our loan.  Did you receive in the mail the survey and information from the Independent Foreclosure Review?  It was a third party company who reached out to homeowners to see if the "big" banks involved in the robo signing suit were fraudulent.  I did fill out the paperwork and that is why I honestly believe Chase approved us because they know they were at fault for denying us in the past for a loan modification and adding on crazy fees.

My thoughts and prayers are with you and your husband during this time.  I will reblog this post.  Have you talked to an attorney?  Does your state offer a judiciary foreclosure mediation program?  New Jersey does.

BOA is the worst to deal with. 

Decisions are made in the best interest of the banks.  Most of these loans were securitized with credit defaults swaps which replaced mortgage insurance.  I have never received an exact amount these swaps covered but I would have to at least assume they replaced the mortgage insurance amount at about 25%.  The only way for the bank to get this payout is through foreclosure (the "default" in credit default swap). 

So here is the example of why they don't want to do it.  Original Purchase in 2005, $400,000 with 10% down equals a $360,000 loan.  Default swap pays $90,000 (25% of the loan) in a foreclosure only...it doesn't pay on a deed in lieu, short sale, or mortgage mod...these are negotiated settlements and not defaults.  Home is worth $250,000 today and you try to do a mortgage mod or short sale on the property.  Here is the issue, someone pays market value (or does a mod) at today's value and the bank is giving up $90,000 in default swap money.  So if they foreclose, the seller takes the appliances out of the property and they can only sell it for $200,000 2 years from now, they still end up with ($200,000 + $90,000) $290,000.  The market is heading up so now, time is the bank's friend. 

Don't believe they are hurting while you don't make payments.  The money they loaned was from other people.  They are only servicing the loan and there are plenty of loans in the pool that are paying that they can deduct from to pay their fees.  Now that the property is considered "distressed", the servicing fees go up 2 to 3 times so the bank makes even more money.  The "banks" who are servicers, will also do force placed insurance at rates many times the going rate to compnaies they (surprize) own or are part of.  Don't worry, they treat the investors who put the money up for the mortgage in the first place equally as crappy as the borrowers.

The only reason they would work it out is they know they don't have the paperwork or that you have been selected to be part of their statistics showing how compassionate they are...a PR ploy.

Now you know why foreclosure is a far better deal for the bank than helping the home owner.  This is why, I believe, these are so difficult.

Gabriel from BOA’s Social Media Department called me at 1:16 PM today and asked for the loan number and address.  He said he will send this information to their Specialty Group for Modifications.  They will research this situation to see if there are any options that they can provide and someone from BOA will call me on Monday.  I asked him to also send it to the Foreclosure Department to ask them to hold off on the foreclosure summons until they investigate whether I’m eligible for a loan modification as we know that the Loan Modification and Foreclosure Departments don’t communicate with one another and operate independently.  He said he would send the notice to all Specialty Groups.

Right after that, Don Pierce, from BOA's Social Media Department for blogging (I think Gabriel may have been Twitter, they divide their social media by type) called me at 1:30 PM and said that he will send this over to their Escalation Team.  A researcher will do an analysis to see if there is anything that can be done and contact me on Monday.  I asked him to request that they hold off on sending the Foreclosure Summons.  He said he would make the request (he has no authority to do anything about it, but can make the request).

So sorry for your troubles.  You MUST call the media.  But first let BOA know that is what you are going to do. BOA does not want media coverage of your type of story. I have it on good authority that an in house BOA memo said that any client who threatens to go to the media gets referred higher up the chain right away.

I am so sorry that you are going through this.  I remember reading that a majority of bankruptcies are a result of a serious illness.  I know several people who have almost lost their homes or lost their homes because of illness expenses and loss of income.

in 2007 and 2008 country faced a financial emergency....it should have stepped in and mandated all government guaranteed loans be altered to fixed rate 4% loans...this could have been done as late as 2009 when the pork laden stimulus was passed that did little to help homeowners keep their homes and so much to help state governments keep overpaid workers and not to mention $100 billion to money losing green energy companies that donated to Obama..

Hi Gail, I am leaving the message below intact.  I didn't see the new entries until now!  That is very good news! 

I haven't been on AR for a while, but I found a link to your blog yesterday morning.  

First, this is a terrible personal tragedy for you and your husband.  You have fought such a valiant fight to take care of your family including your parents and your husband as well as your home.  

Second, this is an example of how the banks have misused the funds we gave them.  Principal reductions and/or interest reductions should have been in the mix from the start to help people save their homes.   This is but one example of the abuses of the banking system since they were blithely deregulated them bit by bit starting in the 1980s.  Now they are monsters with more power than the US Government.  That is the tragedy for our nation and our people. 

Apart from reblogging and pushing it on all my social media sities, I'm trying to think if there are any other ways this can be pushed into the public light.

I'm thinkng in terms of taking this response and bringing it to the attention of the media.  Take care and think good thoughts.  It isn't over yet.

I would like to add my voice to those requesting that your bank do the right thing by Ms. Gail Robinson and everyone in a similar position with regard to their mortgage with your institution.  The intent of Congress and the President was to get banks like yours to make minimal efforts toward the people harmed by your actions in the housing market in the last decade.  Not being proactive and acting in good faith in accomplishing that outcome is unconscionable.

Hi Gail. I have not been on ActiveRain for awhile due to a family concern. I am very disappointed that Bank of America is treating you this way. They bought the servicing of our mortgage and in my experience they have not been very nice to people after they received $45 billion of our tax dollars via TARP2.

Thank you all for your kindness and support.  I have been digging out from a historic blizzard for the past two days - 30 inches of snow and six foot drifts.  Most roads in my City are impassable, but due to my husband's condition I needed to shovel out and get my driveway clear for emergency vehicles even though I am not sure they could even get down my street.  It may take until Friday for the City to plow out my street, but I know I will have to get my husband to the hospital before then for a blood transfusion or some other treatment.  What a mess!

Gail, not sure if you tried this.  I am in the process of a short sale with a loan that was assigne to Select Portfolio from BOA.  The agent there told me to call this number to see if the loan qualifys for pricipal reduction because of the settlement. They sometime won't tell you if your loan qualifies, you have to ask. Bank of America: 1-877-488-7814. Good luck! Sending prayers for you and your husband.

Gail, I hope they work this out for you.  We just started the process with BOA, like you our income tanked, my husband is a union Electrician here in the Hudson Valley.  We were lucky if in the last 7 years he actually worked two.  My income was just not enough to stay on top of everything.  If you have any suggestions that will help, it would be appreciated.  I was hesitant to do a modification, as everyone I know has either been turned down or the amount of the modification was a joke.  An Agent in our office was given an $8.00 reduction.

Their Escalation Team sped the loan modification process up. It passed underwriting and is now in Fannie Mae's hands. It may take two weeks before I know more. They said they would not put in a sale date for the foreclosure during this review. Keeping my fingers crossed!

Gail, you have not finished all your option. You forgot to write a fully documented report to your local mayor, senator and congressional representative. that should start a small cider of a fire, then after that, spend 150.00 for a press release, you need the sympathy vote for this to work.

The start complaining to the local prosecuters that are going after BOA, I know in NY there should be atleast 2 of them, make sure that they get your detailed report. find your local bulldog and let him get a copy.

as heartless as this sounds, the bank does care one bit, it's responsible to it's shareholders and it has a job. good luck.

Michael R, I totally agree with you. I'm sending copies of her original post to my congressional representatives, and senators, too.

I was sending a fax at the local Staples a year or so ago. There was a lady there beside me, who was re-faxing all of her documents for the THIRD TIME, trying to save her home, too. She'd purchased her modest home with a $50,000 downpayment. She'd earned the money by saving her pennies from her small housecleaning business.

She was a emmigrant from the Ukraine, now a naturalized citizen, a divorced mom of grown children, now in her fifties. As she shared her story with me, tears filled her eyes, and mine. She'd done everything - everything, and still she was being told, "you never sent in all the documents."

I had a terrible feeling the Bank wasn't going to help her; they were going to take her $50,000 downpayment, and her little nest egg house, too.

I haven't ever run into her again, but I have never forgotten the discussion we had, or the look on her face as she described her circumstances. We must never forget what the banks have done!

We MUST pass on this story to our government representatives.

Gail, so sorry to hear of your husband. My husband died of pancreatic cancer and myself and our 9 children have missed him. Prayers were answered and you finally got your permanent loan modification. What a relief for your husband and you. Nice it happened before your husband died; I could feel my husband's concerns for me and our kids before he died. Best wishes for the New Year, Gail.
