What Happened To The Draperies?

Draperies in a HomeWhen we’re working with buyers, we always do a final walk-through of the home just prior to closing.

We do this for a number of reasons: to make sure any agreed to repairs have been completed, to see that the home is in the same condition as it was when the contract was executed (normal wear and tear is acceptable), and to make sure that items that were supposed to remain in the home are still there.

The items that seem to come up missing most often are the curtains and draperies.

When this happens it’s not usually a case of the sellers being dishonest, it’s that they were not made aware that the curtains and drapes are considered Accessories in the TREC Promulgated Contract and supposed to remain in the home. If a seller wants to retain them, they should be listed as excluded items in the contract.

We hate walking into a home for that final walk-through and hearing the buyers say, “What happened to the draperies?” These last-minute surprises can be avoided with a clearer understanding of what’s in the contract.

What can we do for you today?

Great post so what is the difference in drape's and curtains? And do most of us know the difference between the two and know what we are looking at? In most cases Drapes are custom made curtians are from the local store and come out of a package one opens washes and places on the windows. AS well drapes use different kinds of hooks and draw strings than do curtians. The type of fabric is different in most cases as well. Draperies Curtians whats on the windows could make a difference on if they stay or of they go with the seller.... But if they are custom made to the window what are the chances that they will fit the next house that you wish to make a home? Hmmmmm one might consider that as well on taking or leaving them. This item might have cost a pretty penny to have done Custom drapes do not come cheap.

Don't you just love those pesky things.  If it's not "excluded" in our Sales Agreements, it's stated that it conveys with the property: window treatments, drapes, curtains, etc.  Hope they get them back.

Everything attached to the home is consider part of the real estate, also the garage openers, keys, etc; so in order to avoid misunderstandings, I prefer to ask sellers to remove the drapes, courtains, rods, or anything they would like to keep for themselves,  maybe the mirrow for the guest bathroom gift from the grandma? please replace it before you list the home,  you don't want to compromise the sale of the home over drapes or something like that.

I've seen a seller replace solid with hollow core interior doors. The buyer really has to be on his toes during that walk-through.

I usually remind my buyers that if they want certain thing(s) to be included, we need to put them in the contract.

I always go over this with my sellers at the time of listing, at the time of contract acceptance and prior to moving. After that many reminders, it would be hard to believe a seller would mistakenly take them.

Window treatments can be interpreted in many ways...sometime the agent thinks it is just the rods or blinds and not the drapes.

I add anything important to the contract, even the unattached garage, or workshop.

Usaually buyers want to select their own drapes...but anything attached to the wall should remain or be replaced with something of equal value.

I love this post and thank you for reminding us as spring comes and high selling season arrives.

In NC drapes/curtains are personal property but blinds and rods are attached and stay...it can be confusing for buyers and sellers if not clearly explained.
