Bogus Credit Report Submitted By Tenant.

We recently received a credit report and rental application from a licensed real estate agent that contained many inconsistencies and raised a number of questions.(both supplied by tenant).

The first 3 pages of the credit report had 3 different origination dates, two of which were last year and with the cover page and a line on the bottom of each page with today’s date on it.

The rental application gave present address as a P.O. Box and a name of a bank as landlord with no contact information. Under former Landlord it was noted as NONE, but on the credit report in the last two years there were 5 former address’s all in the same town.

This applicant wanted to rent a $1.5 million dollar home and this was what was submitted by an experience licensed real estate agent from a nationwide company in one of the richest communities in the U.S.

The landlord was a little flabbergasted at these forms and so we went to the internet to see if we could find anything out. Lord and behold under the State’s Judicial website the applicant was being evicted out of a $2 plus million dollar home (according to state documents a 7 month process …. According to the MLS the home was rented out for $6,000 multiplied by 7 months = $42,000).

When presented the facts the real estate agent was very apologetic and felt betrayed by his client, the manager of this rather large national brand office take-away from this was …..called to say that he was confused...why was $42,000 mentioned in your email


My question to fellow experience ActiveRain members is:

Do you think the tenant’s agent has a responsibly to verify forms submitted by the tenant, especially if they look questionable?

Do you think the office manager reply was correct?

Would you have handled the situation differently? Not say anything?

What is your take-away from this situation?

 

My conclusion to this was that:

This is a huge waste of our agent’s time and company resources along with the possibility of being putting the company's and agents at a liability risk.

I believe that every Manager needs to put a program together for their offices to be able to limit the agent’s exposure to such a situation and protect the brands name.

I was not shocked with your post. It is sad to say that in today's market I see things that go on the market my skin crawl. I think there is a number of agents that are more concerned about their paycheck and will not scratch the surface to find the truth.Hopefully this number of agents is small, but t seem that they are in the news weekly.

i would never accept a credit report from a tenant. that would be my first red flag.  Credit reports need to be pulled the day of application to avoid outdated info.  It should be pulled by the professional on the end of the transaction, the listing agent.

Wow. A few ways to handle a bad app... decline it. Be done. Or charge a deposit large enough to cover the risk factor. Either way, much more fun to get apps that check out. In the case of the agent, yes, verify your clients. We certainly have that responsibility. In the case of the manager. SMH. They should have replied differently, of course.

Thanks for all the wonderful comments, YES there were many red flags in this situation. Always pull the credit report for the landlord directly seems to be the answer plus you really need to do a full back ground check.

The whole point of the credit report is that it demonstrates a particular person's history of paying people back on time.  You absolutely do not want someone who does not do this (pay you back on time) in your financial life.  The last guy may have gotten off easy at $42,000!  I've heard of cases that lasted much longer :-)

Hi David, Roy#8 summed it up. Never as in never accept a report provided by the originator unless you can authenticate and confirm the source without a single doubt - and yet again verify and verify again. Conduct due diligence. The tenant's agent is responsible, so is the landlord's agent.

Best approach is the landlord agent to conduct the due diligence and all reporting. Also equally important is to have the prospect tenant complete a full application, signed and dated. Any misrepresentation on the application is fraud and cause for immediate lease cancellation and eviction. The information on the application must be verifiable and matched against the reports - credit & criminal.

Nope! You will not save the credit application fee by bringing in your own credit report. The credit must be ran by the landlord or their agent.

When I managed rental properties it was always fun for me being the sleuth to uncover whatever else it is that the applicant was trying to hide.  Now on to your questions.

Do you think the tenant’s agent has a responsibly to verify forms submitted by the tenant, especially if they look questionable?  Again as a former property manager, whatever another agent gives me beside my rental application is considered trash anyway.  I did not EVER except a credit report other than the one that I pulled myself.  I would have have even reviewed their report as a preliminary step.

Do you think the office manager reply was correct?  I think the office manager was either as inept as the agent or misunderstood something along the way.

Would you have handled the situation differently? Not say anything?  The only thing that I probably would have done differently was tell the agent at the onset, that I could not accept that credit report and would not review it for consideration. 

What is your take-away from this situation?  As I did when I managed properties, recommend that the prospective tenant go directly through me for the application process.  Even if the agent submitted the information, from that point on, they were hands off.

I don't believe the agent is responsible for the data given to him by someone else...On bogus data, it abounds and is very easy to do but not so easy to spot...the courts have long known that only originals rule the day...NO COPIES...Good post

Hi David- What crazy things some people do and try to get away with.   You did the right thing... I just wrote and blogged about scammers last week and it sums it up.  It's been re-blogged on several occasions already.  It amazes me what one will do to try to get something they want bad.  Keep up the great job and congrats on your gold star.

David the extent some people go to in order to deceive others. Doing your own background check and credit report is essential when screening tenants to prevent any mishaps like this one could have created if someone wasn't paying attention.
