I think most of us would agree that the last thing a person fighting overseas defending our country should have to worry about is their home being foreclosed on back home and having their family put out on the street. According to the U.S. Department of Housing and Urban Development there may be some help in this area.

The “Soldiers and Sailors Civil Relief Act” was completely re-written and re-named the “Servicemembers Civil Relief Act”. The bill was signed into law by President Bush on December 19, 2003. This is the law that now governs legal protections for the members of the United States Military.

Legal Rights and Protections

Service members on “active duty” or “active service”, or a spouse or dependant of such a service member may be entitled to certain legal protections and debt relief pursuant to the Service Members Civil Relief Act (SCRA). In some cases these rights extend to Reservists and members of the National Guard when they are called to active Federal service.

What legal Protections Are Service Members Entitled to Under the SCRA?

If a debt was incurred by a servicemember or servicemember and spouse prior to entering military service the interest rate cannot exceed 6% during the time they are in military service. In the case of a mortgage, trust deed or other security obligation in the nature of a mortgage this limitation on interest rate extends to one year after military service ends.

The SCRA states that in a legal action to enforce a debt against real estate that is filed during, or within 9 months after the servicemember’s military service, the court may stop the proceedings for a period of time, or adjust the debt. Additionally, the sale, foreclosure, or seizure of real estate shall not be valid if it occurs during, or within 9 months after the servicemember’s military service unless the creditor has obtained a valid court order approving the action. There are qualifications to this and the property must have been purchased prior to the time when active duty began.

The SCRA contains many other protections for active servicemembers in addition to those pertaining to home loans. For example, in certain cases leases can be broken without penalty.

How Can a Servicemember Obtain Information About SCRA?

Servicemembers should contact their unit’s Judge Advocate or their installation’s Legal Assistance Officer with questions about SCRA, or for assistance. A military legal assistance office locator can be found at http://legalassistance.law.af.mil/content/locator.php

The SRCA is why some of the largest banks got themselves into hot water over foreclosures a few years ago.  Now if they would step up to the plate and make it easier for those servicemembers still upside down on their home to sell at without the credit issues of a short sale.

Brian, this is very important information for real estate agents who work with military personnel, such as we do in Jacksonville. I second Cindy's comment - this has been a very stressful sentiment from many miltary members we work with who are forced to do a short sale due to PCS.

The lenders need to give our men and women in the service of our country every break they can and not let them pay that additional price for the sacrifice they are making on our behalf. If only this really helped. I have clients deployed overseas whose deadbeat tenants abandoned their home in unlivable condition. They've been told this legislation can't help them because they were already in the military when they purchased the property. Go figure! No way to rent the property and 4 different buyers have walked away from the short sale process... They sometimes just wish Bank of America would foreclose and end this 2-year ordeal for them. Meanwhile, he's deployed and now in Germany after a tour in Afghanistan while all this has been going on. This should not happen to our military families.

Thank you so much for the post Bryan.  I personally have been going through an SCRA nightmare in trying to refi because part of the act allow for deferment of real estate taxes (which we took advantage of) and our county allows an installment payment of these deferred taxes under SCRA.  The problem is that lenders don't know what the heck to do with the law. In trying to refi they decline us saying our taxes are "delinquent" and when we explain the reason they "appear" that way and that they aren't, they find another reason to turn us down because they know they can't say it is for taxes if they are covered under SCRA. It is the most frustrating thing I have ever experienced and I feel it is a slap in the face to a family that has made a sacrifice to our country and followed the laws put in place to protect them.

UGH...the life of a military family.

The Act is good - but the oversight is nil.

I read an article just a few days ago saying that more than 700 active duty servicemen (and women) were illegally foreclosed upon - and the banks admit they did it knowingly! On top of that, more than 6,000 were overcharged by JP Morgan alone.

Even worse news - "...regulators agreed in January to drop the independent review process of the National Mortgage Settlement in lieu of reviews sponsored by the banks themselves." Talk about letting the coyote guard the hen house.

My thought - instead of making the banks pay a fine, make them buy those veterans a new house - and refund overpayment to those who were overcharged.
