Selling a home can be a smooth process if the right steps are taken in the right order. Apart of listing the home is disclosing material facts and any latent defects.  Disclosing this upfront avoids problems and potential lawsuits later.  

 

What am I to disclose?


As a new buyer, most are tuned in to all the details of the house.  As time and life goes on a little problem here and there may or may not be fixed.  Especially small things that don't really bother the individual.  Now it's time to sell the home!  Most sellers assume because they don't have a issue with something, a new buyer shouldn't, but unfortunately buyers (and their home inspectors) don't usually agree.  DISCLOSE EVERYTHING.  If you have to ask "do I need to disclose this?" DISCLOSE IT!

 

What am I responsible to fix?

Real Estate is local.  Each county, city and state has their rules and laws per the contract.  Any home owner considering a selling a home should meet with a local REALTOR.  The contract in the state of Maryland reads that appliances and the like should all be working properly.  The only exception would be short sale, foreclosure or estate as these properties are AS-IS.  If it's broken, not working right, works only when the skies are blue and the moons align FIX IT!  

Latent defects also need to be disclosed.  A latent defect is a defect is a fault in the property that could not have been discovered by a reasonably thorough inspection before the sale. For example if there is a light rain no problems, but a super heavy rain there is a leak, DISCLOSE IT!  If you fix it, DISCLOSE IT and save and provide documentation that it's been fixed.   

 

How can I make sure I won't have problems?

DISCLOSE DISCLOSE DISCLOSE! Putting all cards on the table and providing documentation that existing issues have been resolved is the best way to ensure a sucessful sale and happy buyers.  This way a buyer will have all the information and make the best decision to move forward with the home.

Disclose, disclose, disclose is the second rule of Real Estate right after location, location, location.  Always better safe than sorry.

disclose, disclose, disclose no questions asked.. too funny when they ask, should I disclose this?... I tell them they just did to me so it gets passed on to the world...
