Amarillo TX and Angel Fire NM Seller's Disclousure

When you list your Amarillo real estate or Angel Fire, NM home for sale you will have to fill out a sellers disclosure form. The seller’s disclosure form states everything that you know about the home. When filling out this form, you will need to be as honest as you possibly can about your property. If you have property damage that you are aware of such as water damage, mold damage, lead paint, major repairs, etc, you will need to be honest and disclose it.

What do I need to disclose when selling my home?

You will need to disclose everything you can think of that a buyer would want to know before they purchase your home. Has the home had termite damage in the past? When was the roof last replaced? Has there been a flood in the home? Is there lead paint in the home? Is there asbestos in the home?

Those are just a small sampling of items you should disclose to potential buyers. If your home was purchased before 1974 there may still be lead-based paint in the home. When there is lead-based in the home, you must disclose it. If you don’t know, then simply say, “I don’t know”. If there was damage to the home before you purchased it and you’re not sure what it was simply say, “I’m not sure”. And, if you are aware of anything that was disclosed in the previous seller’s disclosure, you need to add that to your seller’s disclosure too.

Even if you are an investor and purchase a home to rent out, you should tell your renters if there are any major problems with the home. Again, if you’re not sure and really don’t know, simply say, “I don’t know”. After you disclose all the information you know, it is then up to the buyer to investigate further. Or, they can take you at your word.

Note: If you deliberately lie about anything on the seller’s disclosure that could be potentially harmful to potential buyers and someone can prove you lied, you can be held liable for a lawsuit. Therefore, it is best to be honest upfront and have no worries later on.
