Can I prohibit a purchase by a homosexual when I list my home for sale?

Can I prohibit a purchase by a homosexual when I list my home for sale?

For personal reasons, a Maryland home owner does not wish to sell his home to homosexual buyers.  He further commented that he looked a HUD Fair Housing Poster and did not see homosexuals listed as a protected class.  What advice should be provided by the listing agent?

Let’s hope that we are never asked this question in Maryland since there has been so much publicity about the approval of same-sex marriages.  The Federal law has a number of protected classes that should be red flags in our minds when we discuss housing discrimination.  The Federal protected classes are color, familial status, national origin, physical or mental disability, race, religion and sex. In the Federal context, race means male or female.  Homosexuality is not mentioned.

However, there are state and local laws that further protect consumers from housing discrimination.  In Maryland, the Federal classes are certainly protected and there are two additional protected classes.  The additional State protected classes are marital status and sexual orientation.  The marital status protection refers to the state of being single, married, separated, divorced or widowed.  The sexual orientation protection refers to the identification of an individual as to male or female homosexuality, heterosexuality or bisexuality.

The home owner that had thoughts of excluding homosexuals as a class of purchasers needs to understand that the exclusion would not be legal and the listing agent could not comply with the request.

Local laws offer additional layers of fair housing protection for consumers.  Under Montgomery County, MD law, a person cannot be discriminated against because of race, color, religious creed, ancestry, national origin, sex, marital status, disability, presence of children, family responsibilities, source of income, sexual orientation, gender identity or age.

That is always a tough question to be asked.  At least in your state you have different classifications that go beyond the Federal housing laws, that would protect the homosexual community.  So, that makes the law a way for you  to "bow out" of such a working relationship with the homeowner.

Common sense, is to keep your home open to ALL prospective home buyers.  They may pay the right price!!

I hope that no one ever has the choice about who can purchase their house. Not only is that unjust, but unnecessary. When I do a consult with a homeowner, I tell them once their house is listed, it is no longer theirs, it is a product.

It amazes me that a question like that one would ever be asked!  I agree with Peg in her #2 comment - "Not only is that unjust, but unnecessary."  I've never been confronted with that question.  I'm glad I never have!

I might add that during the early 1990s, an agent in my office had an upscale home listed for sale.  It soon had an offer submitted by a prominent Sacramentan, and it was accepted.  Near the end of the escrow, it was disclosed the seller had AIDS.  The buyer immediately walked away from the sale.  It was in the days when mass hysteria surrounded that disease.  Ironically the buyer died several months later, from a massive heart attack.

I agree with the remarks above.  Hard to imagine the various biases people still hold on to.  I would say Karma ruled in Myrl 2nd comment...it is not always that fast, but it makes the road trip around eventually. :)

Roy, States can enhance the Fair Housing laws if they choose. I don't understand why people want to limit who buys. All money is green.

There is still much prejudice in our country. I sometimes think it is not getting better. Too bad anyone in the Realtor community is faced with these kinds of questions.

I have never had someone ask me to discriminate against a certain type or class of person. I hope it never happens, but you never know. It would anger me and I wouldn't work with that seller.

As commented by Joe, there is still much prejudice in the country. We live in a very diverse area with over 120 countries represented by the residents in the 20878 zip code. Diverse cultures provide different lines of thought on many of our day to day issues.

It is sometimes a good idea to revisit our old blogs and reblogs. We might even find some good ideas for new posts.
