Here Comes THE JUDGE - Bankruptcy and Selling Your House!

If you have had a Bankruptcy in the past and you want to sell your house.... TELL YOUR AGENT.  The last thing you want to do is end up with an offer to purchase on your house and you can’t sell.

 

Remember it is a material fact!  It must be disclosed.  If you have not had it discharged, before you can sell you must take care of this.  

 

In North Carolina you must petition the court to hire a real estate agent and then when there is a contract you must petition the court to release the home from the bankruptcy.  If you don’t you may have a mess on your hands.  Not to mention a lot of very angry people including the buyer, who is probably out a lot of money and now you are potentially facing a lawsuit.

 

My advice is to see your bankruptcy attorney and get heard in court.  Yes that means a JUDGE!



The Judge may not be too pleased with you if you list your house, get a contract, wait until there is a problem and then come see the judge.  

 

The North Carolina listing agreement mentions bankruptcy several places and when you sign that document you are agreeing that you have disclosed everything and that everything filled out on that document is in fact correct.  


Don’t get hung up in court, with people mad and possibly lose your buyer ..... it pays to be upfront with your real estate agent.
