We had the tenant taking the landlord to court for failure to properly return security deposit in a ressonable amount of time. The landlord accused the tenant of leaving his unit trashed so he kept the security deposit in order to make his unit rent ready. However, each state has their own laws regarding security deposits. Well, Judge Judy sided with the tenant because the landlord failed to properly send a Security Deposit Disposition Lette.  So, she awarded the tenant twice the rent for damages. The landlord was shocked on the verdict. However, that was the law for that state. Yes, we have to follow the rule of the land when it comes to tenant/landlord disputes. Furthermore, the landlord failed to have proper documentation including move in/move out inspection with pictures to prove his case. Yes, the tenants know the laws better than the property owner.

Now, we deal with these type of scenarios monthly when it comes to Phoenix Property Management. Tenants must give us a 30 day written notice that they will be leaving their unit. Next, we will schedule a final move out inspection with the tenant present. Yes, the iPad is a great tool for this type of work.

Nice post Harry.  I've always wondered why many people are so quick to want to buy and rent out investment properties while being so slow to learn the rules governing them.

Hi Harry,

It's amazing how something that seems so simple can be so complicated. This is why I always recommend property management to my clients who do rentals. They can't keep up with the details of the law, but you can.

I send my check-out cleaning checklist and I have a 20% service charge for any cleaning or repairs that I need to take from a departing tenants' deposit...this is their incentive to have the property in GOOD and CLEAN condition when they vacate!

Yes, understanding the laws related to security deposits is extremely important. For instance, though I morally agree with Wallace's 20% surcharge I don't know that it would be defensible in Solano Courts here in CA. It is best to hire a local professional.
