The seller can't rescind their counter offer -  or can they?

 

This past week we had another smoking hot Phoenix listing with offers. After meeting with the sellers they decided that they wanted to counter only one of the offers. They did so as per normal in writing.  We gave the buyers 24 hours to accept or reject the counter offer. The buyers agent emailed me in the morning saying the buyer accepted the counter. I said that's great but a contract is not a valid until it's in writing. She understood and said she'd work on getting the counter offer back to me before 1:00 instead of later that evening.

An hour after that discussion with that agent, another agent called wanting to submit an offer - all cash considerably higher than the previous offer. I let her know there was a counter offer pending and expected back by 1:00.  She then wanted to know if they wrote an offer right away and got it to me would the seller consider their offer. I let her know I'd call the seller and find out. Seller said yes - bring on the other offer. She then had to consider if she wanted to rescind the previous counter offer still pending or keep it on the table.  She decided to keep the 1st counter offer in play until after the 2nd offer came in to see if it had the terms and conditions as the other agents said it would.

 

We did receive the other offer within a half an hour but we didn't have the proof of funds in hand for the all cash sale. I discussed again with the seller what the options were at this point. Did she want to rescind the counter offer on the table or keep it in play - knowing  full well we still needed to get the proof of funds from the new buyers. She wanted to take her chances and rescind the offer.  At that point I called and emailed the agent and rescinded the counter offer per the sellers instructions. Of course it wasn't the news neither her nor her buyers wanted but she knew that the seller had the right to do so. The agent then said, respectfully, would it be ok for my buyers to submit another offer?  Well of course it would.  I let her know I would be meeting with the seller in 2 hours and I would present both offers at the same time.

 

I met with the seller and guess who's offer was on the table?  Yup - the 1st buyer came up in price and showed that she was ready, willing and able to close within 2 weeks - all cash.  Those terms were very attractive to the seller and she accepted it on the spot. Inspections are complete, docs are signed, and we're closing next Friday. Everybody is happy even though there were some up and downs in the process.  Both the buyer and their agent did an excellent job of dealing with the situation of our hot and very competitive Phoenix real estate market. 

 

Having and experienced professional agent on your side whether you are the buyer or seller is critical in a competitive market. It takes a great deal of finesse and skill to navigate the choppy waters - per se - in the Phoenix desert!

Jerry experience does help tremendously in any market but especially in hot sellers markets with low inventory and lots of buyers wanting the same home.

Margaret of course but even more so in highly competitive markets. Agents must be playing their A+ game with no room for errors and timing is critical.

Hella I think the agent was trying to get that buyer to move but they somehow didn't give it the importance it needed.  Worked out better for my seller but if I were a buyer I sure wouldn't be dragging me feet one tiny bit. BTW the 2nd time around they got it back immediately.

Ralph - I am glad it worked out very  well for my seller.

Prayful experience makes a difference in negotiations. No wimps in that club!  LOL

Sharon - agreed there is so much to be learned and shared on ActiveRain.

Rekha - many would think so and if they don't know it - it would be wise for them to figure it out before they begin the process.

Debbie - it's been hot for awhile now.  Low inventory and prices are climbing - but at a more normal pace thankfully.

Sheila we're back and hoping to stay this way for a very long time.....and then some!

Susan - don't we all know that one after making it through the last 6+ years in this country.

Lenn - exactly. And that is so easy these days there is no excuse to not be on the spot ready.

Wayne well - we've been dealing with multiple offers for a long time in our market. 1st it was for foreclosures, than short sales and now it's traditional sales.  I'm glad I know how to handle them like a tiger!

Dee - wait 2 minutes and there just might be sold!

Alexandra - it pretty normal here but this one had a twist, with a drag your feet buyer and another buyer willing to take her place.  Seller is pleased with a quick close so all worked out well.

Chris we could do that but just in case the agent doesn't watch their email I take that extra step and make the call.  Better that way to deal with the agent up front so I've learned over the years.

Michael timing makes a big difference - and representing YOUR clients best interests.

Barbara - you'll like this one. She found me by reading my ActiveRain neighborhood niche blog posts.

Dick - subtle many times is the operative word. And having a professional agent on the co-op side is the best bet of making that happen.

Harry - good for you!  Glad to see you back in the rain!

Lyn - there really wasn't a problem for MY seller - in fact it turned out better that the buyer dragged her feet.  Now if I were the buyer I would have wised I would not have done that.

Jeff - funny thing is the buyer is from CA and quite a savvy buyer so I was told.  They own a 5M dollar home somewhere in your neck of the woods.

Aarron - there will be more buyers right behind them for sure.  At least that is our current market.

Helen and Larry - all is good and you're right - that buyers agent kept her cool and explained exactly how her buyer could get back in the ball game. Had she not we would have moved on to the next buyer - and there would have been more.

Joe - as they say the top 20% of agents are doing 80% of the business and there is a reason for that.

Seems a great maneuver by the first agent to keep it cool and her buyer in the game. You too!! No reason with digital signatures and email that a counter and acceptance can not be time stamped and immediately emailed. Plus proof of funds and a pre approval letter should be in hand prior to going looking in a hot market.

Ms. Anna Banana, the hot market causes all sorts of situations that need to be carefully navigated by a pro, like yourself.  Your situation is just one example of a common occurrence in this kind of market.   Another very similar situation that I've had is where buyer #1 accepts the counter offer in writing and gets it back to the listing agent.  Then, maybe 30 minutes later, buyer #2 (unaware that the home is in contract) submits a much higher and better offer which the seller wishes they could accept, but of course can't.   For me, it's another reason why setting up a presentation date and putting it into the listing makes sense in this kind of market.

Anna, the arena of multiple offers is upon us again in many markets.  It can be crazy, but it is nice in a way now that demand has returned.

Glad to see it all worked out. I worked a deal last year where agent number one said we'd be violating the law if we didn't accept their offer as we verbally agreed to.

D & D  no reason at all where quick response can't happen in this day and time.  And as you mentioned it's important to have all your 'ducks' in a row before you submit an offer.  I just wrote about this this other day...

Karen - you will continue to see this as it's been going on for some time in the GPA.  Lenders will keep a lid on this and that should keep it going in the right direction.

Greg - guess he or she needs to learn how it really works. Verbal means holds no water.

Kudos to the first agent who kept her cool. So many agent get angry when you tell them there is another offer but it generally gets you nowhere when you react that way.

It pays to know and understand the paperwork you're signing. We had a situation once where a buyer drug his feet on signing the seller's counter and someone else came along and bought the property. He was steaming mad and ready to sue until we reminded him of the words on the counter-offer form.

Charles - it can and most likely will continue for some time in our market and many others.

Marte I think a lot of the issues arise when agents do NOT explain what they need to do so close the deal.  They don't let the  buyer fully understand the urgency of accepting the counter if all is good for them - and doing so immediately before somebody else can slide underneath them.  I've had buyers on that side and you can bet I make it very clear!
