Today it was announced that in Dutchess County, a County Bill was passed requiring landords to test their well for contaminants;  also anyone thinking of selling their house would be required to have this test done.  This test is expected to cost around $500 and according to a local testing lab I contacted, the test would involve several samples and would require 25-28 separate tests.

This bill would have to be okayed by the County Executive before it would become law, at this stage he is considering having each municipality pass their own water testing law.  The county has only one Board of Health Department whose responsibility it is to review the bill before it could be enacted into law.

This is very important because the majority of housholds in the county get their water supply from private wells.

The  big question now is if this becomes law  will the buyers be comfortable with the homeowner having the reponsibility of having the test done; or will the buyers want to conduct the test at his or her own expense as is the practice now?

Only time will tell.

Another example of good intentions doing bad things to innocent sellers and landlords.

That fee for a simple water test is outrageous.

WOW $500 that is a lot of money to require a Seller to spend.

George :  This is alot of money. The buyers usually like to conduct their own independent test, so are they going to be forced into spending $500 also?

Good question, but at a cost of $500 I would probably accept the Sellers tests.

George:  Maybe the seller could wait until the inspection to have the test done thus saving the buyer $500, just a thought.

Again New York leads the way in not increaing taxes...we didn't say not increasing fees. New York politricians are in a battle that is not unique to New York. At the top the State Legislature refuses to increase taxes and yet demands relief to constituents from all levels. They then mandate that local municipalities handle all of goodies that the state level requires. They don't send money though.

What happens is that each area of local government and the parts of the state government need to raise their opwn capital through services. Unlike the free market wherre if your service is unnecessary you won't collect... they can mandate the service through local and state laws. We should be so lucky.

Real Estate is a business of independent buyers and sellers coming to agreement over the market valuye of their property. Contracts often dictate that specific testing be done. The more we let the government run our busnesses the greater the chance is that our freedoms will be reduced in these areas. With that goes profitability.

Who is really paying for this? Obviously the consumer under the guise of protection. Okay, step away from the soap box and move to the rubber room.
