A Counter Offer Doesn't Always Mean "Counter Back"....

 sun Despite the much "warmer climate" that many markets are having....the sun shining on higher prices, shorter days on market and more sales....there are agents who believe the know more than the market indicates. 

    You can always tell when the counter received has been cleverly crafted by an agent....and not just the wish of a buyer for a lower price.  It is more involved...closing costs are charged to the Sellers....additional items on the wish list that most buyers would know was possible.

    We received just such an offer....and spent time with our Sellers and they agreed....generously we think....to meet the Buyers half way.  We believe that is the best way to respond when possible  and tells the Buyers...AND their agent that they are being fair and negotiating in the best possible spirit.   We sent over the counter and left voice mail....the agent claimed  a day later not to having gotten either one....lather, rinse, repeat.    The counter is swiftly returned....

With another counter....

  We call the agent.....and tell her that we believe our Sellers have shown more than good faith in negotiation and why was this not accepted.....She was flustered....in the name of working FOR the Buyer...she thohalfwayught she could chisel more "benefit" with coming back to the original numbers.

    I told her that was not happening....that the lack of "spirit" on the part of the buyers can cost them more than the money at stake.  Now...and we have seen it happen many times...the yard equipment they might have left....the little extras that make things easier for the Buyers are likely not to happen.  The Sellers are not feeling as kindly toward the Buyers as they might have, had the counter been accepted.

    Working for the Buyer doesn't mean having the last word...it DOES mean getting an offer accepted that is fair....and not negotiating in good faith often means a loss of the "feel good" parts of a transaction.  We will explain to our Sellers...it was not the Buyers...but the Agent who cleverly crafted the counter to the counter...the Buyers are not to be blamed for things they would never have thought of doing. 

   The bad taste is already there....and hard to erase.  We serve as Buyers' Agents....and work to fair representation and as amicable a transaction as possible. The rewards for the Buyers can be many...the discount on the snowblower...leaving the lawnmower, the extra  bulbs for the chandelier...the little things and some not so little that make this people business a pleasure.

Things always seem to go smoother later when the negotiations are more fair and reasonable.  I've seen many a new homeowner the day or two after closing speak both very highly and very poorly of the seller.  And, those with good experiences have been much happier moving in and received several benefits later.

Good advice. Buyers think they can ask for whatever they wish after the inspection and start negotiating again.

The art of negotiation can be tricky in a situation like you described, but you are working in the best interest of your seller.

We also believe Joe...that an agent working in the best interest of the Buyer will recognize a Seller's willing to negotiate in good faith...and do likewise.

Its all in the negotiations and I let the buyer decide if they will counter the counter.  If they ask my opinion I tell them otherwise I do not try and influence their decision.  that's just me.

Sally & David, sometimes the alpha party in a negotiation can sour the opposite party to the point that jut one more demand in the negotiation process will result in not only a flat rejection, but a refusal to deal with the other party in contemplation of the sales transaction. I think in many cases one of the parties was profiled as a child? You hope they will learn their lesson, but when their agent fuels the fire, this makes it truly a recipe for failure.

Great comment Norman.....that high cost of being right can be a rejection....and no one wins.

Ah yes Gabe...that urge for "creative writing" done under the guise of "working for the buyer"....doesn't  work when they have gotten the seller so turned off they "just say no."

Yup, try to squeeze very dime out of the seller and the buyer will lose.  The agent might puff up their chest like a big old proud bird but they are really doing a disservice to their customer.

What the buyer's side fails to realize also is that it's not over after the contract has been signed.  Inevitably later on down the road, the difficult buyer or buyer's side will "need" the seller at some point before closing. There will be a price to pay.

What some people just don't understand is real estate is governed by the emotional pulls from the people involved. A sure way to screw up a negotiation is to make one side angry, because they'll cut off their noses to spite their faces and just walk away.

Hi Sally,

I can always tell when an agent crafts a counter too and it's very annoying. For many, it's a game and they don't even try to facilitate a sales, they try to control it and that's wrong. Unfortunatetely, there are many who don't follow the Code.

Your expertise in how to handle negotiations is superb. This is another great example of why I'd choose to do business with you and recommend anyone needing to buy or sell to contact you. When it comes to negotiations you're a specialist and fair.

  We have an accepted offer....with Our Sellers countering the same counter as the first time....and hopefully the selling agent a tad wiser.
