When I receive an offer after listing your *home for sale, I will review the 'main points' quickly, then give you a call to set up a time to go over it in person. I know the first thing you want to hear is the price they are offering, but there are many more details to consider.
1. Price
2. Down payment
3. Earnest money deposit – type of funds and delivery date
4. Loan pre-approval (is it strong?)/proof of funds
5. Possession and closing dates
6. Contingency and resolution deadlines
7. Inclusions/exclusions
8. Any additional provisions
9. Do buyer names match signature?
10. Check address and legal description
11. Request for seller concessions
12. Type of mortgage buyer will be obtaining, or is it a cash offer
13. Who pays for what? (Appraisal, HOA docs, closing costs, survey, title work, etc.)
14. Is there a contingency on the sale of another property?
15. Type of title and coverage specified
16. Are e-signature boxes checked, if applicable
Before arriving for our meeting I will confirm with the buyers' agent that I received the offer and ask for any needed clarifications, and attempt to contact the lender to get a feel for how they do their job.
Together, we will discuss each item, how it affects you, and whether it makes the offer 'strong', or 'weak'. You can choose to accept the offer as is, reject the offer outright, or counter the offer. A counter offer can address any of the terms, not just the price. The buyer(s) can choose to accept the terms of the counter offer, in which case you would be 'under contract', or not. They may move on to other listings, or try submitting another offer that gives you some of what you wanted while keeping some things they want to remain the same.
