Underground Storage Tanks In New Jersey

Underground storage tanks (UST) are an issue effecting all counties in New Jersey. They can be found in commercial as well as residential property. Here are links detailing the policies and procedures regarding underground storage tank installation, testing, removal and remediation when necessary.

The definition of an UST, as set forth in N.J.A.C. 7:14B-1.6: is any one or combination of tanks, as set forth in N.J.A.C. 7:14B-1.4, including appurtenant pipes, lines, fixtures, and other related equipment, used to contain an accumulation of hazardous substances, the volume of which, including the volume of the appurtenant pipes, lines, fixtures and other related equipment, is 10 percent or more beneath the surface of the ground. A 'Tank' is a stationary device designed to contain an accumulation of hazardous substance which is constructed of non-earthen materials (for example, concrete, steel, plastic) that provide structural support.

NOTICE: There is an ongoing state grant program that provides reimbursement to homeowners of up to $1,200 for closure/removal of non-leaking underground oil tank and up to $3,000 for closure/removal/replacement of an underground tank.  The reimbursement program also covers costs for removal of tanks rectroactive to August 6, 2006. What are USTs and why do we regulate them? - About 650,000 underground storage tank systems (USTs) nationwide store petroleum or hazardous substances that can harm the environment and human health if the USTs release their stored contents. The Office of Underground Storage Tanks (OUST) was created in 1985 to carry out a Congressional mandate to develop and implement a regulatory program for underground storage tank (UST) systems.
