Sad That The Coldwell Banker Peru Blog Copies Our Content Word For Word

My general manager, Alicia Yabeta, has one of the leading spanish language real estate blogs.  In March 2007, she wrote a very popular blog post in Spanish:http://casacomprar.wordpress.com/2007/03/07/lecciones-desde-las-video-entrevistas-como-ser-un-buen-agente-de-bienes-raices/

which on 5 January 2008 was copied word for word at http://coldwellbankerperu.blog.com/2494578/ by one of their agents, Enrique Vilca Garcilazo

The author of the blog post refuses to pull down the content and actualy has copied several others. His provider, Blog.com, doesnt respond to email or phone calls.  This obviously reflects poorly on Coldwell Banker - any ideas how to get Coldwell Banker Peru to pull the plug on the duplicate copy?

I suggest the author (and thus copyright holder) contact Coldwell Banker Peru directly and point out that Peru has been a member of the Berne Convention (international copyright treaty) since August 20, 1988, and that this applies.  This is, of course, if Peru does not have brokers the way we have here or that you've contacted the broker and they, too, have taken no action.

when I post something on-line, I am ready to share it with others. If they like to copy it, please do. I am not a Jack London. It is blog, not a novel. But if someone copies a great material, would be nice if they mansion the original source.

Tricia: Thanks for your comment and advice.  We havent tried the broker..just the agent.  That seems like the right next step.

Irina: There is fair use (which includes a a subset of the contect and link back) but in this case its the entire article of a business blog post.  Imagine if you'd feel the same way if that person started to rank higher in Google for copied content and others started to linking to "their" article after finding it in search engines?  Thanks for stopping by and taking the time to comment.

Content theft is illegal & this comes up often in a popular real estate forum I'm a member of. A forum member gave a link to this page about content theft.  Hope you can take care of this.  Best of luck!

Start taking it up the line with your Coldwell Banker representatives.  Try your regional service director and keep moving up from there all the way to Jim Gillespie if you have to.  That's part of having a great brand like Coldwell Banker behind you, there are people that will help get things done behind the scenes.

I don't know....maybe you can broker a deal with the Peruvian Cartel, and have them send some guys over to their office?

I think taking it to Coldwell Banker to see what they will say and do. If they are not helpful. maybe create a blog "I hate Coldwell Banker Peru" or maybe "No me gusta Coldwell Banker Peru". then you would come up when people search for them. Underhanded yes, but if they are not responsive, it might just be the way to go.

Frank, the forum I belong to did the same thing when one of our members faced content theft.  Prior to getting the page (the actual forum post with a title not very flattering to the offender) this thief was acting very cavalier and would one day remove the content but sneak it back the next.

Because that forum was so popular it quickly went to the #1 position when you searched for the agent's name.  So when anyone did that search, the 1st thing they saw was this terrible headline (His name-Unethical his town REALTOR) to the long thread about this agent and his theft.

Boy, did that change things.  He finally took down the offending stolen content and had to wait patiently as the forum post died (since the forum's owner killed the post in agreement that this guy keeps his word).  

If CB Peru doesn't cease & desist, we can work on getting this post to the top for when people search for "Coldwell Banker Peru."  Probably not a popular search term, but not something the brokerage would want to see on Google.

Send an email to Lenn Harley, Active Rain blogger.  She is the most successful person I know in matters like this.  She has been awarded monetary damages in the tens of thousands of dollars.

Content theft affects us all. There may be some who don't care and others who may feel flattered. The majority however do not feel that way. A simple request often will result in a Yes YOU CAN use my stuff. Taking it without permission will often lead to a quite opposite reaction. Keep us posted.

Tony, this is pathetic. This will come back to bite this guy in the ass. You have total right to be upset about this. CasaComprar.com is one of the best real estate related blogs in Spanish on the Internet and duplicate content damages your reputation in google.com. Please let me know how I can help. I saw the page you posted on twitter. Let me know if you want me to link to that. Also, it would be a good idea to have the text you added in Spanish. If we optimize for Coldwell Banker Peru you will definitely get some attention from the main office in Peru and they will put pressure on the agent. Let me know if you want help with this. This stuff really bothers me.
