Years ago in the Loon Mountain area the concept of planned unit development sprang up, this is a different type of ownership from the condominium property.

A PUD is an attached whole ownership townhouse, in which owners own the ground below the structure. This allows the owner a little more flexibility with floor plans and future changes to the building design. The Village of Loon Mountain Resort is an example of this type of development. The original developer saw the upside of selling the site and having restrictive covenants on the style, size and even the color of the structure (that would be allowed to be built). The down side was everyone in the building initially had to agree to build at the same time.

The condominium concept differs in the sense that these were built first then sold with specific common area maintenance budgets implied. In the condo ownership you generally own only from the walls inward and all the exterior aspects are controlled and maintained through the fees set aside to pay for the upkeep. The main difference between the two is in a PUD you get the bill when it's time to paint or re-roof, and in a condo the owners association has set aside a capital reserve to take care of the big ticket items at their predicted ware out date. It is a case of you can pay me now (and hopefully have no special assessments or surprises) or you can pay me later (at what ever cost is deemed necessary at the time).

From a development stand point the PUD allowed the land owner to collect money for the land before the building, and a condo developer controls everything about the project but doesn't get paid until the unit is ready.

Leave it to a Realtor to skirt the edge of profanity and if not for a little humor could any of us get up every morning and head back to the trenches to wage the battle against mortgage brokers, title companies and unsympathetic condo boards that can't bring them selves to completing a condo questionnaire in a timely manner. And I just walked in!
