"The court is appointing you to replace the present Realtor," the attorney said. The call was  followed by a detailed email.  "I have to warn you...." he continued. Thoughts race thru my head....it is a family law attorney so it is most likely a divorce...maybe there is a restraining order...the house is in bad physical shape....just waited for the other shoe to drop ...holding my breath...

   The lawyer said that the Realtor listed and re-listed the house high above the market price ...now, months later...the house must be sold...and there had been about 30 showings...but no offers.  Another price "adjustment" to a price that the market would accept he believed, may put the divorcing couple, upside down. He asked that we do a "blind analysis" initially to see if his suspicion was correct....indeed it was.  Now, he said, both attorneys and the couple fear that if the soon to be former Realtor, furnishes a list of protected buyers, one of them may write on the property and become HER buyer.   Their fear was because...the agent was relatively new and had no short sale training or experience.  The couple and the attorney had no faith in her ability at all he said based on her performance to date.  What would happen if one of the protected buyers DID write on the property  and the Sellers have no confidence in the agent's ability to close this short sale ?  (There are multiple liens and other issues.)

Good question.....and I will be sending it to the HOT LINE of our state association this morning.  There is always something different happening with interesting twists and turns....What do you think Realtors ?  We'll let you know what the state association has to say in another blog.

Good luck with the listing. I would guess the listing agent can only have the list of her buyer clients not the ones shown by other agents. I wonder what the attorney will say.

If, and it's a big "IF", the other agent produces a protected list of prospective buyers names, they MUST back it up with a written BA Agreement substantiating the names and dates of protection.

Since the agent didn't produce a written offer, they'd likely be willing to agree to a small referral fee if one of the buyers buys the house.

The attorney and the court was wise to make this move, but it should have been months ago. Hopefully the property ill sell quickly so these folks can move on with their lives.

Sounds like a mess, and good luck getting the divorcing couple to cooperate in the short sale process. I had one 2-3 years ago where husband refused to sign anything, then packed up and moved to Canada.

Sally & David- I haven't a clue but I will look forward to the rest of the saga.  It seems to me that having to have a court appointed attorney would make the other agent either turn and walk away or at the very least be willing to accept a modest referral.
