Flood Insurance Program Changes Alert and Startling- Get Ready Now

Thousands of people are going to be affected by the changes in the NATIONAL FLOOD INSURANCE PROGRAM. New national government policies went into effect on October 1, 2013.  Essentially, the premiums on many of the exisiting flood policies receiving a "prefirm rate" (previously grandfathered rate) will go up 25% annually until it reaches the proper non-subsidized rate (what ever that is)!   For current flood policies that are affected by a flood zone change starting in 2014, their premiums will go up 20% per year until it reaches the "proper non-subsidized rate".  

All required flood insurance now must be escrowed if you have a mortgage.  Flood policies can no longer be transferred to new homeowners (no grandfather clause).  Lapsed flood policies will be reinstated at the new rate. Elevation Certificates (only obtainable from a surveyor or if the current owner has a recent certificate - not a survey- this is a separate certificate) are now required on all A and V flood zones. 

If you are planning to buy an oceanfront home, intracoastal waterway, riverfront, lakefront or any other waterfront, have your insurance agent run a flood zone check on any property you are interested in purchasing BEFORE you even write a contract.  For current prefirm rated policies, get a flood elevation certificate to determine if you are eligible for a premium savings if you do not already have one when you bought the house.  For planned flood map changes please see http://www.floodsmart.gov to see if a flood zone change is planned for your zip code or has already occured.

Look for the DFIRM (Digital Flood Insurance Rate Map) effective date for your zip code.  According to the FloodSmart website "The affected properties are among those built before the community joined the National Flood Insurance Program (NFIP) and adopted its first Flood Insurance Rate Map (FIRM). Communities began joining the NFIP in the late 1960s. To find out when your community joined, contact your local floodplain manager. Properties built before that date and not improved since are known as "pre-FIRM."

It goes on further to say "Many of the pre-FIRM properties in high-risk areas do not meet current standards for construction and elevation, and they have been receiving subsidized rates that do not reflect their actual risk. The subsidized rates are being eliminated in some cases. Some current policyholders and all future policyholders owning pre-FIRM properties in high-risk areas will pay rates based on their full risk of flood damage. However, most NFIP-insured properties (80 percent or more) are not affected by the changes."   Look closely at the Biggert-Waters Flood Insurance Reform Act of 2012 on this government website to understand further how this bill will affect your pocketbook. 
Obviously this affects both sellers and buyers.  Sellers need to be proactive if they want to sell their waterfront property when this takes affect in your area.  Buyers ... well, "caveat emptor" is the motto.  Let me know if you need referrals to excellent insurance agents and surveyors in the Ponte Vedra Beach, Florida area.  I am happy to make the connection. Just going through this RIGHT NOW and my buyers are checking the rates BEFORE moving forward with a contract. The crazy thing is that we really do not know how bad it will actually end up being for several more years. YIKES!

Hi Joan Whitebrook,  What you may have read is that Congress is considering revising the Act but this became LAW in 2012 and effective to start on October 1, 2013.

Kathleen -- Excellent advice to have the insurance agent run a flood zone check prior to the contract. Did that on a property a few years back and found out that it was indeed in a zone requiring an additonal monthly premium of $400.  Buyers couldn't afford that. Better to find out sooner rather than later.

Dear Barbara,

It is wise to get the buyers to find out first before they get to emotionally involved with their dream house. If I have a seller I am asking for the elevation certificate ahead of the listing and then approaching their current policy holder to get a quote with a new rate.  If I have the buyer side, I am requesting the elevation certificate and trying to get estimates before showing the proprerty.  This will save me and my sellers and buyers valuable time.  Good luck to you!

Yes! "Disclose" I agree and have just done the very same with my seller. Our buyer DO get emotionally involved so work and emotions are better saved before hand than in the end. Thanks all for sharing...Laura

Kathleen, an elevation certificate from the seller is a must right at time of listing.  If you can't get it from the seller, you may have to get it from the county.

So many FEMA maps in our area are so so out of whack and not accurate. Requiring one by one exception surveys at $750 a pop for the obvious.

Hello Silva,

To the best of my knowledge, the county does not keep individual home elevation certificates on file.  The elevation certificate must be recent.  Being a surveyor as a career is looking more and more attractive. 

The seller or buyer needs to obtain the elevation certificate. As of this moment I do not know of language in our real estate purchase and sales agreements that require a seller or buyer to purchase/provide the elevation certificate.  This is a totally separate charge and process by a surveyor from the site survey. The elevation on a survey is not an elevation certificate.

Please check FEMA's new site http://www.floodsmart.gov and see if they have made or plant to make changes to your areas in Maine by using zip codes.  That $750 is just the start of fees buyers or sellers will be seeing.  Thanks for your input.
