Things changed since 2007-2008. E-notarization, enotary, electronic Notary Public is a reality. For Real Estate, Virginia is all set. The State allows for two different types of notary commissions to be issued in the Commonwealth; traditional notary public commissions and electronic notary public commissions. The Commonwealth of Virginia will be the first state to authorize a principal signer to be in a remote location and have a document notarized electronically.
California requires the signer to appear before the notary public for all notary acts and Civil code 1633.11 states that an electronic signature carries the same legal effect as a physical signature made by a pen.
