What's The Difference Between A Seller's Agent And A Selling Agent?
At first glance, one would think that the seller's agent and the selling agent are one and the same right? To the the home buyer and seller it also might look the same, but there is a HUGE difference!
Here in the Portland Metro area, real estate agents are actually given the broker title (which can also be confusing to some). I recently had a client have concern as to why I was representing both the seller and them as the selling broker (which was on a document). Although I discussed things with them when we first sat down and went over the Oregon Real Estate Disclosure Pamphlet which outlines both the Buyer and Seller broker duties, I can see how this slight change can be confusing.
So, what's the difference between a seller's agent and a selling agent? Besides the "er" and the "ing" here is the difference:
Sell-er's Agent/Broker: Also known as the listing agent and represents the seller only. They work with the seller to LIST and market the home for sale and work with the sellers through the negotiation and sale process.
Sell-ing Agent/Broker: Also known as the buyer's agent and represents the buyer only. They work with the buyer to find that perfect home and once found, they work closely with the buyers through the offer and sale process.
Another way to look at this is that the seller's agent lists the home for sale while the selling agent brings in the buyer..so sells the home. Even though it's legal in Oregon for an agent to represent both the buyer and a seller in the same transaction as a dual agent, I personally don't practice this. This can be a fairly common practice with the sale of certain types of homes or in certain locations like new construction or homes in rural areas.
