For over 20 years (1972-92), I visited the different courts across Southern California while managing properties and doing my own Unlawful Detainers, small claims actions and disputes and while waiting for my cases to be called, I heard everyone else's case.
 
FROM THE JUDGES MOUTH TO MY EARS
 
Anytime they ruled in favor for  or against a clause in a contract, I took note and changed my contracts accordingly. The result? I had the premiere rental agreement in the business for years...it was coveted by landlords, treated tenants fairly and all the courts always agreed and honored it...
 
REAL ESTATE: RISKY BUSINESS
 
It was a gift given to me. Back in the eighties, when there was a dispute, everyone ran to court. Landlords were at risk because the courts were clogged making your issue take months to be heard. Tenants knew this too. Even if you charged large deposits, they still never covered a long drawn out outcome. Often the Landlord would lose even if they won
 
UNTESTED AGREEMENTS ABOUNDED
 
Back then there were so many untested rental agreements all over the place. Stationary stores sold a generic form that barely covered the relationships. Mom and dad landlords would scribble something out and many made contracts that were just not enforceable because they weren't legal according to contract law. Finding this out afterwards can be very expensive
 
LEGAL AID WAS PRO TENANT
 
Legal aide was also available to help any tenant that was being oppressed (?) and they would tear your agreement apart as well as make motions that dragged out a simple pay the rent agreement. An agreement has to hold up or Real Estate enters into severe jeopardy. They would attack the agreement and prevail. Meanwhile, I took note after note...
 
PSYCHOLOGICAL WARFARE
 
I learned a long time ago that the effect of the agreement was more than just clauses and law. The psychological aspect is enormous. People knew what they signed and agreed too and if it was presented in easy to read and follow dynamics, fighting it was hopeless and foolish. Often people who did oppose it used it to buy time. Legal aid was good at buying people time
 
COURTS WERE IFFY ON SMALL PRINT
 
I did away with small print. The courts frowned on it and many a tenant would remark they never even seen the very clause point I was making. Stating paragraph 13, item 1 second line after item b seemed and sounded ridiculous. The courts more than not agreed. I wanted people not only to see certain clauses, but initial too. There is no way around denying the clause after that.
 
AN AGREEMENT IS LIKE A FOUNDATION
 
A good agreement works before, during and after a tenancy. Back in the eighties, renting property out was high risk and many landlords stood to lose their properties with disputed rents, damages and vacancies. Something had to be done until the courts became more balanced. This agreement was part of our management services back then and many of our clients signed on because of it. IT WAS OUR BRAND.  Some just wanted the agreement only. I used to give it to them freely with this statement:
 
THE PITCH THAT BEAT A PATH TO MY DOOR
 
Sure, have no doubt you are now holding the finest most effective agreement in the business of Real Estate property management bar none. However, the more shrewd investors and owners seek out the author of this agreement for the full coverage and pay-off value.
 
HIRE A PROFESSIONAL
 
Business boomed....and for the people who paid the rent and obeyed the common sense rules, the agreement was near worthless. If one hired a professional and went the 20-30 year distance on rental property, it all pays off in $$$$$$$...Getting there however is another story

Hello Jan...Once I caught the flow of creating a premiere agreement, I used  large legal sized writing pads and even developed a type of personal shorthand for making notes. People must have thought I was a court reporter

Hella...Yes to your potent statement. Property Management is for those that are called to do it. Your skills bank should line up with the profession as it is demanding and relentless...thank you

Sarah & Lester...yes to your mention of 2 weeks. A person puts an investment of hundreds of thousands of dollars in the hands of someone else hoping for the best?

Jeff...making the decision mentioned in your decent commenting is RIGHT thinking. I have clients now who just get the rent month after month year after year courtesy of a professional manager for a small fee charged by me. Why not?

Gita...smart commenting by you because it brings in cause & effect which is very much apart of this (or any) process. Yes, Landlords were out of control with demands, invasion of privacy, theft, harassment and greed. The shift to a renters market was born.

THE CONTRACT

Many years ago, I asked my brother if he still had one and said NO but it wouldn't be too hard to track a copy down since tens of thousands (probably hundreds by now) of them existed and probably still do throughout greater Los Angeles area. I wanted one just for AULD LANG SYNE (times gone by) and then I wanted one for use when I started doing private management again. However, the CAR forms were available and effective and I went with those plus the courts came around and did their job...STILL..I would love to have one myself.

Michael...Allow me to boast, attorneys wanted it badly. It was tried, tested and complete and I spent more time in the courts than the majority of attorneys did at that time. it was the end all to the subject matter bar none Thank you

Dan...let me share. I discovered an additional strategy that pays off to this day. IT WAS THIS: I fed back to the courts exactly what they wanted to hear and were looking for. When they heard it and saw it, they ruled in my favor EVEN before the case was fully heard. I learned to do ALL my documents that way so that they spoke to the judge as well as the persons signing. Today, that is missing in many communications and is the cause of many unnecessary losses in the courtroom. TALK TO THE JUDGE in everything you do was our company mantra..Still is for me as it is a habit now...thank you for allowing me to expand the posting

Michael...I couldn't write fast enough and I was so excited when I heard arguments by experienced expensive attorneys over clause interpretation and then the judges having the final word no matter what was said. When the judge would rule, he would state why and the gold just flowed from his mouth. Out of THE HORSES MOUTH (s) came rental agreements born right in front of my face. 20 years worth BTW...AND...There is no defense against them...NONE..ZERO....end of story if you signed it...

A COUPLE OF STORIES

Mike...thank you for your comment. I always prepared for my own trials and hi-lighted my clause points. Copies were always in front of the judge and I knew court etiquette. If I heard this once, I heard it a thousand times out of the presiding judge right at the beginning asking the defendant: DID YOU SIGN THIS AGREEMENT? From there, I used to get a silent signal from the bench: to make my presentation brief because I won and I made it brief and I always won. Legal aid, attorneys and other people never knew what hit them...In another story, I had a judge who I appeared before often state in a packed open court that Mr. Naggar who is acting as his own attorney will go first and I want everyone to follow his presentation. They knew my ducks quacked law & order, my paperwork perfect and predictable. RESULT: We had the largest property management firm of its time and location. $$$$$ plus results for all

PAPERWORK OR NO PAPERWORK...COCKINESS IS A LOSER

Just to balance out my boast of success, one day when appearing on my sure thing agreement, I sat in the attorneys section and I was not an attorney. When they called my SURE THING slam dunk case and I stood up in the attorneys section and then I was severely lambasted, reprimanded and made a laughing stock by the Judge in front of 15 attorneys and then told to get the heck of of the court and refile everything agreement be dammed!...ARROGANCE NEVER PAYS OFF...

Mike...if you have a "killer" lease as you put it, you and everyone who signed it KNOWS this too including the judge...Good example to make the point of being pro-active even in your written documents...

LADIES & GENTLEMAN...Shrewd attorneys would argue successfully over the mis-use of even ONE WORD in an agreement. I made notes on those ONE WORD-ERS

Richie to Rich...Not even attorneys spent the time in court as I did. I heard so many cases that I could tell you who would win before it was over. Later on, I was to do just that when asked by other attorneys..How am I doing? I would tell them where they were failing or if they hit their mark. Amazing educational journey for me

LADIES & GENTLEMAN

Some trials would break for lunch and resume afterwards. I used to stay even after my case was heard. I also used to go early and listen to cases before mine too. I then used to go to the courts on my days off as well. This was before they became popular on TV as I found them to be places of learning for every day issues. I visited with Civil, criminal, family, bankruptcy, small claims and traffic courts often. BTW..I knew how to beat tickets and would tell people before their case was called what to say and what not to say but they wouldn't listen...Too emotional instead of strategic...They learned but the hard way

Doug...this comment of yours is very important and potent. I have clients who from time to time start looking at how much I make monthly instead of their steady portion every month year after year. I have to remind them that things are running smoothly because I manage them so...DON'T ROCK THE BOAT and be happy in your share...or suffer the consequences...People have no idea until after they are burned

Jon...you love it...this common sense that you mention in your comment because you are that practicing type man...Amazing how simple things really are and how human beings make them complex. It is like shooting your self in the foot. WHY?

Having a good agreement in place is one of the reasons we, as REALTORS, suggest clients use us and our forms.  A lot of time and money has been invested in the C.A.R. forms to make sure all parties are treated fairly in the courts.

Richie you're a very smart cookie - but we all knew that.  Having really good forms in place and explaining them to each client as well as getting them to intial the very important items is crucial. Many agents fly over contracts and wonder why there are problems after the fact. That's easy - pro's handle it correctly from start to finish.
