The Sheriff is Not the Last Short Sale Word in Wisconsin....

  upside down houseWisconsin is a very consumer friendly state...and that applies to the legal procedures for foreclosure as well as other laws.  Sometimes we are introduced to a Short Sale seller very late in the pre-foreclosure proceedings...the foreclosure clock continues to run legally while the distressed Seller may be trying to sell the house.

   sheriffWe had just such a case...the house had been listed with another agent and the Seller called and asked us to list it...he had no showings and time was short before the Sheriff would be putting the house for sale and it would be foreclosed.

     Constant contact with the lender warning of the impending date....reinforcing that we had an excellent cash offer brought the lender promise that the sale would be stopped.....and as sometimes happens in corporate lending America....it was not.gavel

   The next step in foreclosure proceedings in Wisconsin is the confirmation hearing....and until that hearing is held and the gavel finally sounds...the Seller has the opportunity to complete the short sale and avoid foreclosure.  We explained that to the deaf ears of the Lender....climbing the escalation ladder winding thru the legal department...no no...that cannot be...they never heard of such a thing.  That may well be....but we did not make it up...it is a law...and they should have some obligation to at least investigate it.  We climbed to the top of the corporate ladder and the Vice President attempted to investigate the situation with the help of the local legal counsel....and the clock continued to run.

  judge   We cannot let this happen....so we wrote a letter to the judge....and hand delivered it to his clerk.  The judge was not available and we told the clerk that the letter was very urgent.

   The next day....we receive a call from the courtroom....we are on the record and the judge agrees with us....we have 3 weeks to get this short sale approved.....and so it was !

It says as we have told them ....this one and others...we don't make up the laws....if they won't listen to us....listen to the counsel they hired locally....and have not been given a direct line of communication to explain the law....do they really WANT to know..hmmmm....
