Do You Know Where Your Buyer Is?

You may have seen the Television spot on TV where it starts out with "Do you know where your child is?" A campaign that was launched when the cities had evening curfews late at night for children under a certain age.  The main purpose was to cut down on the juvenile crimes in the area.

Just like the children that roamed the city street late at night, getting into mischief, I am suggesting our own campaign to keep our buyers from going astray.  Buyers are not aware of the Real Estate Agents rules that dictates that the Buyer and the Real Estate Agent they choose are suppose to be tied together until they move into their new home.

 

RULES TO YOURSELF

• Make sure the Buyer is aware that you are a commissioned agent, and that you are working in their best interest.

• Buyer Broker contracts are not always your best legal option. The best option is to not get in that position in the first place. Most agents will not enforce them, but it can be a tool upfront to emphasize that you are their only agent.

• Buyers will continue looking on line for homes

• Buyers will see a sign while they are driving down the street.  It is real easy for them to call the number on the sign to ask questions about the house.

• Make sure the buyer is aware that you have the answers to all the homes they see, and to call you for the information.

• It is easy for them to top at an open house. Have them call you before looking at it and then remind them to tell the agent at the location that they already have an agent. Best if you go with them.

• Know what your Buyer is doing and remind them occasionally what the rules are. Any time they bring up something about a house they saw or read about, remind them again what you are to them.

 

We have all lost buyers to other agents, either do to them ignoring the rules because of convenience, or they don't care. The best way to teach them in the beginning is:

You wouldn't go into a School other than your own for Math or English class, just because you happen to be driving by it at that moment.  Why would you go to a different Real Estate Agent,  when they are not your advisor or teacher?

Hi Kathleen, A Buyer Broker contract basically guarantees that the agent will get paid the commission of you go to some other agent to buy.

I tell buyers that they are perfectly welcome to attend any open houses, but to please be considerate and let the agen know they are working with me.  In NJ any buyer who attends a "public" open house is not considered to have entered into any kind of agency agreement or a "procuring cause". I once met a buyer at my  open house. Then, at their request went to their townhome and spent 2 hours with them.  I had a second public open house and invited them back which they attended. They were very much interested in putting an offer on my listing.  Then, WAIT A COTTON PICKIN MINUTE, they listed the townhouse with another agent and brought her to my listing so that she could show it to them and write up the offer. Yep, it was all legitimate. (but, totally not in the spirit of how we work!!!) As luck would have it, I had 4 offers including one of my own before the "other" agent could get her act together and write up an offer.  My buyer (not the sleazebags) got the home.  I learned a valuable lesson.  Have the buyers you meet from an open house come for a showing outside of the open house in order to be considered the "procuring cause".

Thank you for all of the great responses. This was a bad week for "losing" potential buyers, so I will be more forthcoming (and watchful) with my buyers in the future.

Something I keep meaning to do:

One Agent somewhere make little necklace type name tags for their Buyer Client that said "Joe Whoever is MY Buyer's Agent", and told them to look at any Open House they felt like, BUT to wear that when they went in. This way the Agent there wouldn't "bug them" and no issues should develop later...

I am probably repeating what has already been said – probably more than once – but it is impossible to chain a client to us. We have seen plenty of cases where clients have gone astray even when under a buyer-broker contract. It is the education of and hard work on behalf our clients that keep them bound to us. And even then…that is not always enough. It is part of the life of a Realtor. It is also a lesson learned when it happens so that extra effort and thought goes into satisfying the needs of the next client.

Hi Richard and Beth, We always use a Buyer Agency. But Buyers sometimes ignore them and use other Agents anyway.  You just go on to the next client.  Better tht getting mixed up with getting a bad reputation of suing everyone.
