What do you have to disclose and what can you hide? Asked a Home Owner looking to List their Home. I was interviewing with the owner when they asked me this. The correct answer is a seller has to disclose everything they know. They did not like my answer and told me another agent from a BIG company told they did not have to say anything. lI let them know that whether selling a home in the MANCHESTER NH AREA,. or anywhere, the correct thing to do is to disclose everything on the Seller property Information report.

 

 

They told me their furnace always shuts off and there seems to be a lack of heat. I walked through the home with them and when we got to the basement took a look at their furnace, it is less than 10 years old but had no service tags. They asked what that was. I told them you get one when you have your furnace cleaned. They said they have never had their oil furnace cleaned. I let them know they should do it every year.

 

i also noticed they finished their basement and closed in the furnace in a small closet like space, there is no fresh air getting to it to assist it in functioning. between these 2 items i may have found their problem in an instant. They told me to mind my own business. i told them Good luck in selling their home, but i ONLY do things right and can not take instructions against the law, ethics and how I do business. When they are ready to do things the right way, i am here to help them.

 

Home Sellers do not always want to hear the truth, but not only will the truth set you free, it will help you sell you home. if the only reason they are selling is because their furnace is not working, for less than a couple hundred bucks their furnace could be cleaned and a make up air tube put in.

I think the disclosure letter or statement is vital. But as you know the seller hide behind the statement "I have no knowledge". Even though they do.

Q-Man, it is also imperative that when the listing agent learns of something wrong with the property after the disclosures have been answered, that the agent needs to discuss it with the sellers to update the disclosures or write something as an addendum...even just a piece of paper with something written in their own words and signed/dated by the owners. I know that when I learn something, and I am representing the buyers, also, that I ethically have to share that information.

John Q  Great choice for a re-blog.  Yes, yes, yes is always the right answer.  I tell people the Seller's Property Disclosure is designed to keep you out of court.  If you disclosed the roof leaked and they want to sue you in 6 months because you didn't tell them...you have their signature that you did disclose it!

This is good reminder for me as I am listing a rental property and had a fireplace inspection which reveals about $1,500 of work needed.  I will get it done to avoid any problems.
