Rental Restricted Communities, Yay or Nay?

When you purchase a home in a Home Owner's Association with Covenants, Conditions and Restrictions (CC&R's), the expectation is complete compliance. I was asked, "When considering a home to purchase, is a  rental restricted community the way to go?"

It depends on the intended and full use of the home plus expectations to be consistently met by the owner.

In some such communities, there are no rentals. The only exception is a few existing homes that are grandfathered in, with original home owners in place. Once the property exchanges ownership however, the rental advantage goes away forever. This is pretty much set in stone.

The catalyst behind such a rule is that renters do not take care of a property as an owner would, it keeps property values up, everything in it's place, etc. On the flip side, when life changes occur, such as loss of employment, illness, divorce, an owner is unable to lease the home and may create a hardship.

Wanda, I know several owners that have questioned whether not being about to rent their unit is smart. It just depends what their intentions are. Overall it will keep thecommunity nice.

Debbie, It seems that buying a second home in this type of community works best for convenience and an HOA does help keep the neighborhoods clean and pristine.

personal taste, but for me I would be taking a second look if rentals were allowed.

Bill, I have had conversations with home owners regarding this type of scenario and they are in favor of allowing rentals. They feel it should be part of their rights as property owners.

I've seen communities that allow no rentals or those with burdensome restrictions loose value.  Though, I do like sensible and reasonable restrictions to keep a community desirable and attractive.

Dear Wanda -
Here in Atlanta, I have seen communities DESTROYED by those strict restrictions. Unable to sell, homes went to foreclosure. Lot worse maintenance than a rental!

I think the covenants should allow for rentals with a fee paid to the HOA for oversight. Not to be chec king every day but to have funds within the HOA to take action WITH THAT OWNER'S MONEY if the property is not kept in wonderful condition.

Just reviewed the doc's for a community that allows for those steps - Let me know if you want me to send that section to you.

I think many HOA/Condo Assoc. are very protective of their community's LENDABILITY !!!

Gets the job done!

As a homeowner it is better to live among other home owners.  There does seem to be a critical level of rentals that bring down the neighborhood.

Lynn, Great point and viable solution to problem rentals. Yes, I'd like that information if you will send it!

I can see that Michael, Everything in it's place is the expectation in HOA communities!

Debbie, The mindset would tell you that homes are better kept when owner occupied but zero rentals? Unrealistic for many HOA's out there!
