Often when we discuss contracts, rules, agreements , covenants, etc...we say that they have to "teeth" to be enforced. Without any consequence whether it is a child ignoring curfew, a divorcing not allowing showings, refusal to sign documents in a timely manner, etc., etc., there is no reason to adhere or obey the rule. We hear complaints from other Realtors..."The deal fell apart because the spouse refused to....." Head the problem off at the pass....refusal is not an option.
If you have been recommended by a lawyer, or appointed by a judge to be Realtor of record...part of what you need are the teeth of the agreement. Teeth are not the polite nod of cooperation and "Yes ma'am/sir/judge I will ....". What you need is the judge to write an order that reads in part.."Both members of the couple agree to cooperate completely with the Realtors on a timely basis. Any lack of cooperation will be reported to the court and is punishable by whatever the court deems appropriate. Here, it often 30 days in jail
We often use the expression “put it in writing” in this business….have the judge write that order and find the ”happily ever after” at closing for all concerned.
