If You Drive High You Will Get A DUID In Colorado...that's the law in Colorado. DUID means driving under the influence of drugs. In fact the state is spending $1 million dollars on a campaign, called Driving High Will Get you a DUI, to educate drivers that driving under the influence of marijuana will get you arrested.

Just as the recreational sale of marijuana is being regulated the same as alcohol sales...pot use and driving is being treated the same way as drinking and driving. The state has set an impairment level. That is 5 nanograms per milliliter of blood of active THC. That doesn't mean much to most of us, but it does show the state is serious and has set parameters for impairment. The penalties for driving stoned are similar to the penalties for drunk driving. You will lose your license and have to attend substance abuse classes, etc. The financial fines are stiff. I've been told a DUI in Colorado will cost you about $10,000. 

Many of Colorado's law enforcement officers are specially trained to detect someone under the influence of drugs. These officers are called Drug Recognition Experts or DRE for short. There are special roadside maneuvers that are used when an officer believes that someone is driving under the influence of drugs. Reaction and response time are measured. The driver will be asked to get out of the vehicle and submit to the roadside tests. 

Driving high is not only particular to Colorado. Even before marijuana was legalized, you still had those that used the drug and this is true across the nation. So dealing with a stoned driver isn't something new to law enforcement. 

There is also an open container law. If you have marijuana in the car and the package has been opened, that is like having an open bottle of alcohol in the car. You will get arrested. 

Colorado has an express consent law. This means that any driver has to consent to a chemical test if a police officer has reasonable grounds to believe that person is under the influence of drugs, alcohol or both. Refusing to consent means the driver will automatically lose driving privileges, be classified as a persistent drunk driver and have the ignition interlock put on the vehicle for two years. Substance abuse classes and therapy will also be required. 

Losing your driving privileges is nothing to fool around with. Play it safe. If you drive high you will get a DUID in Colorado.

Debbie Laity, it sounds like Colorado is taking safety into consideration, while making progressive moves, like the legalization of marijuana. I wonder how Delta County has changed with CO's state changes.

I have been hearing quite a bit about this and I think it is really important for us as a state to set the standards for safe driving. As the legalization of MMJ spreads throughout the country we will be a cornerstone for other states to look at as a successful model. Although, I do wish they had allocated a larger portion of the tax dollars to bringing back lost school programs (art, music, etc) rather than taking all of the left overs to give to this new MMJ DUID task force. Maybe next year.

This will become more of an issue in the next few years, Debbie.  And, Minnesota is really taking a very careful approach to legalization.  Whether or not, it becomes a law, it is important to not only watch your driving, but those around you.  Cellphones are and should be an important part of the IMPAIRED driving laws, too.

Pot users should stay at home. It is easy to forget the risk of accidents that may cause injuries or deaths. I am glad to see that police officers have the necessary extra training to recognize drivers under the influence of drugs.
