If You Drive High You Will Get A DUID In Colorado...that's the law in Colorado. DUID means driving under the influence of drugs. In fact the state is spending $1 million dollars on a campaign, called Driving High Will Get you a DUI, to educate drivers that driving under the influence of marijuana will get you arrested.
Just as the recreational sale of marijuana is being regulated the same as alcohol sales...pot use and driving is being treated the same way as drinking and driving. The state has set an impairment level. That is 5 nanograms per milliliter of blood of active THC. That doesn't mean much to most of us, but it does show the state is serious and has set parameters for impairment. The penalties for driving stoned are similar to the penalties for drunk driving. You will lose your license and have to attend substance abuse classes, etc. The financial fines are stiff. I've been told a DUI in Colorado will cost you about $10,000.
Many of Colorado's law enforcement officers are specially trained to detect someone under the influence of drugs. These officers are called Drug Recognition Experts or DRE for short. There are special roadside maneuvers that are used when an officer believes that someone is driving under the influence of drugs. Reaction and response time are measured. The driver will be asked to get out of the vehicle and submit to the roadside tests.
Driving high is not only particular to Colorado. Even before marijuana was legalized, you still had those that used the drug and this is true across the nation. So dealing with a stoned driver isn't something new to law enforcement.
There is also an open container law. If you have marijuana in the car and the package has been opened, that is like having an open bottle of alcohol in the car. You will get arrested.
Colorado has an express consent law. This means that any driver has to consent to a chemical test if a police officer has reasonable grounds to believe that person is under the influence of drugs, alcohol or both. Refusing to consent means the driver will automatically lose driving privileges, be classified as a persistent drunk driver and have the ignition interlock put on the vehicle for two years. Substance abuse classes and therapy will also be required.
Losing your driving privileges is nothing to fool around with. Play it safe. If you drive high you will get a DUID in Colorado.
