I have a client that put a contract on a Town home in Lawrenceville Georgia mid September 2007 with a national builder. The Builders policy is not to start construction until all units were sold in that building. The builder released the building in early February (with 2 units not sold) and set the closing for May 2008. This is where the fun begins! I was driving by the Community last week and noticed that the entrance sign read a lower price than what my client's contract read. When I approached the sales agent she confirmed that the base price had in-fact been lowered and gave me the new price sheet. She also stated that they were going to pass this savings on to my client but not until 2 weeks prior to closing,and only if the prices had not gone back up! She also stated that her building company takes care of their home-buyers and she was sure they would take care of my client. So...why should my client pay more for her town home than others purchasing now and closing at the same time? Usually you get a better deal the earlier you purchase in a community or at a close out.  If this builder truly cares about their home-buyers then why are they excluding my client? When they decided to reduce prices it put my client in a $19,387.00 deficit maybe I'm crazy but you do the math. She would be better off terminating the contract and losing $2000, turn around and re-write on the same unit!

I wanted to update everyone on the out come of my last posting.

As it turns out, the Builder was very gracious and extended to my client the reduction in price. Needless to say my client is very happy :)

OK here is a question. if the price goes back up by May, 2008 then does all those that locked in at a lower price have to move up in price? That only makes it right with your buyer? right? This does not sound like such a great deal now? I do not know what to do if you have non-refundable earnest monies with this also? what a tuff call? and it will always be in the clients back of their mind? I would go to the attorneys office for the company and see what they say about it. I would find out legally what I could do to help my clients.

Hi Susan.. to answer your question..NO...the contract stays at the lower price for all contracts written. Her earnest money is not refundable..but would still be a better deal to terminate than to take the chance that the prices will go up. You right it's a difficult situation, one I intend to win!

Hi Virginia - In my past I worked for a national home builder...... 1) Is the home that your client put money down on the EXACT model that is offered at the lower price? 2) Did the builder omit some of the inclusions to reduce the price?  3) IF it is the exact same model -  my advice would be to contact upper management - or if it's a small builder, the head man/woman and get the base price on your clients home reduced!!

Lots of luck.  They may not take your buyer back, builders can get quite nasty about things like that.

No in fact they added some features. 3)IF it is the exact same model? yes, As of this morning I have been in constent contact with the sales manager for that area. They are meeting about my amendment and she is hopeful they will sign it!! Thanks for your advice and responding.

Hi Virginia,

Glad to hear they are meeting.  The other thing the builder has to consider - once they've reduced the price and taken new sales at that price - they  won't be able to get an appraisal at the value your clients paid.  That is in your favor.

Virginia - I worked for a builder who did not make price adjustments to buyers in escrow when he lowered his prices.  I don't work there anymore.  Let us know the results.
