It was the buyers REA asking for the inspection report. I said no problem and then ask if she got my clients (hers too) permission to receive a copy. She said yes. I told her I would forward it to her the next day.

As I lie in bed I'm thinking why didn't the REA just ask our client to forward it to her. So I got up in the middle of the night and emailed my client asking if he gave permission to the REA. He did not respond so I called him. He was not a very happy camper with his REA and he never gave her permission. 

 The moral of the story is get confirmation from the source.

Excellent advice. Never take the word of an REA, especially one with whom you have never done business with in the past.

That is great advice Mitchell.  I have a statement that the buyer has to initial on my inspection agreement that gives me the okay to share the report.  If it's not initialed it doesn't get distributed.

Hi, Mitchell -  Our inspectors here have the buyers sign forms with all kinds of information... I've mentioned this before.  One of those forms, with the buyer's signature, has space for the buyer to list who can receive the report.  It gives you that answer in writing... food for thought.

Fortunately here in Wisconsin, if you have an inspection and raise any issue you are required to give the report to the seller. If you don't raise an issue with the inspection the buyer is not required to give a copy to the seller.

I email the report to my clients. If the RA's ask for a copy, I suggest that the client will email them a copy if they feel inclined.

I agree with Bruce.

once the report is paid for and given to the client it is theirs to do whatever, so put the burden on the RE

to ask them for it.

I have had the RE ask and I simply call the client and get their permission to pass it along.

follow ethics and standards and don't worry about small stuff!
