Once again I am turning to ActiveRain for information - it seems whenever I run into a problem and don't know the answer, if I post it here I get the answer! What a wonderful place AR is!!!! From computers to health questions, our members share what they know!

Well, here I go again with something that I cannot answer:

I received a call from a client who intends to purchase the end of the year (simply needs to build up their credit a little longer) - they are renting right now and this afternoon when they answered the door, there was someone from the county clerk's office with papers for the owner of their condo - the owner lives in another city - they told this person that and he gave them a copy of the paperwork, saying they needed to know that the mortgage is 3 months behind and the place is being foreclosed on.

They supplied this person from the county office with the owner's phone numbers and then called me asking what they should do. Since I have never been in this position and I am NOT a lawyer, I hesitate to give any kind of advice.

But the biggest questions they had were:

should they continue paying rent?

can they be evicted before their lease is up if the place is being foreclosed on?

My comment was that I think it can take up to 6 months for all the paperwork to go through, but I really don't know.

Anybody out there have comments, opinions, non-binding advice???? I would love to hear it!!!

Wow! This is a pickle your clients are in. I am with Fran. You will probably be able to find some help and advice on the internet as well. Each state has different eviction standards. Here in Texas it is quite easy to evict. Likewise in Vegas, you could get rid of someone in just a week or so. Arizona was more difficult and a longer process.

We had a similar instance here recently. The attorney advised the clients that in our state one will be given up to 120 days to vacate the premises AFTER the foreclosure.   As far as payment, he laughed and said do you really think the owner has the money to start an eviction, but legally yes the tenants are obligated to pay their rent and should because in our state the foreclosure often goes over a year.
