You Need to Call Your Buyer's Agent, That Isn't Me!

 

 

I represent the sellers on their current home.  It is under contract and we have already negotiated inspections, appraisal has been completed and we are waiting for the closing at the end of the month.

 

Prior to meeting me, they had listed their current home with another broker and agent AND executed a subject to sale purchase for a replacement home.  After three months on the market with little to no activity, they decided to change agents.  They called me based on a referral from a friend.

 

Luckily, we had just one showing and the buyers wrote an offer immediately.  It was sale pending within two weeks.  This started the buying process for my sellers on their replacement property with their buyer's agent.  On the selling side, it is all smooth sailing.

On the buyer's side for my sellers, not so much.  Inspections were completed last week on the replacement property and I am receiving frustrating calls from my seller asking for my advice on their purchase.  Ummm...I am not the buyer's agent on that property.  I am not getting paid to represent them.  Frustrating for the seller/buyer and frustrating for me.  

 

But, I don't represent them on that purchase and all I can say, is call your buyer's agent, it isn't me!

Hi Ed! That was their intent, the buyer's agent attempted to sell their home.  It didn't sell so when it expired, they called me off of a referral from a friend.  Their offer on the replacement property was set to expire in less than 30 days.  I think that they had hoped that the offer would expire as well and they could start over with me.  Because I sold their existing home so quickly, the other agent was still representing them.  At the time, I felt that was only fair as I had nothing to do with their purchase.  Sucks to be in the middle and not be able to help!  Thank you for reading.

Hi Richie! That is definitely true.  They called me prior to their listing expiring with the buyer's agent.  Which by Iowa law, they can do.  I cannot solicit them, but they can call me.  We met and started our listing agreement three days after the current one had expired.  

Hi Scott!  They never want to hear that.  I explained to them that they should defer all questions on the purchase to their buyer's agent.  I also explained the liability involved if I were to interfere.  Just won't do it.  Thank you for reading.

Hi Pete!  I know better than to get involved.  It would end up biting me on the butt.

Hi Brian!  They had entered the contract to buy the other property prior to listing their home months ago.  They had offered subject to sale of the current one which was listed initially BY the buyer's agent.  Only when it didn't sell after several months and had expired, did I list their home as the second agent and it sold quickly.  Trust me, they wanted to find a way out of that purchase with her representing them.  I told them no.

Yikes.... sometimes the consumer makes the mistake of working with an agent that is on the lower end of the information and service chain. It happens in all professions. All we can do is be professional in our representation and empathize with the client in their other situation.

Tough situation, but this is why we have rules and ethics or else it would be a turkey shoot or worse out there. Always hard with older clients as you often have to explain things slowly and several times to make sure they understand.  Hopefully it does work out for them and you can help them where you can without crossing any ethical lines.

They are just going to the person that seemed knowledgeable and had been helpful to them, or was it just luck getting the first buyer in the door for their home? I would just help them out,  if I could.

Karen, That is a tough situation, on one hand you have a business relationship, just not in the purchase of their new home.  Good thing that we have the Code of Ethics to assist us.

Can't tell you the number of times this has happened to me, ie., a buyer calls me about something or the other . . . then I ask "Are you working with an agent," and they tell me they are, but their agent is out of town.  They want me to tell them what to do?  Can't, sorry!

Of course they are going to call you :), you made their home selling easy.  It can definitely be frustrating, but IMO as long as you aren't interfering with the process on the buyers side, I wouldn't mind providing some advice.  It can be hard for an older couple to understand what is going on.  Lots of luck

Karen, I feel your pain. I've had a few former clients do that when they've moved to another area. I always try to direct them to their buyer's agent, but sometimes they want a little hand-holding. That's about all I can do since I'm not in their market.

Good way for them to get you into trouble. Sounds like an agent that doesn't do their job or at least explain things to the buyer.

I see nothing wrong with telling them to call their agent's broker if they are having issues. That is the person they need to call anyway!

Karen- I had this happen with a good friend/agent who'd referred me for staging.  My new client did not use my friend as her buyer's agent for her new home but continued to call her with questions.  All she could do was exactly what you did... suggest she call her buyer's agent.

I would call the buyers agent and explain the situation to her. Then I would ask her to get on a 3 way with the sellers or meet in person to go over things. This will put them at ease and make you look like a very helpful caring person. If this does not work, ask the buyers agent for permission via email to explain things to your sellers that they are not understanding from her.

Hi JC!  I am sympathetic, but the seller/buyer understands why I cannot help.  They have decided to move forward at this point and just accept that they made a poor decision with this agent representing them.  It is too bad.  He has written this agent off and I am sure that he will tell anyone that will listen about that bad experience.  Not all agents are the same.

Hi Nick and Trudy!  True.  It takes extra patience with older clients.  They don't necessarily understand why I cannot assist them if I am available.  I can just listen and send them back to the other agent.  It will all work out.  Thank you for reading.

Hi Olga!  They called me today.  Told me that they were just going to accept that their buyer's agent was not going to "go to the mat for them" and move forward.  They went on to tell me that they knew that I would have gone the extra mile with them the same way that I have done assisting with calling contractors for the repairs required with the sale of their home.  Thank you for reading.

Hi Brenda!  They know that I would have gone to the mat for them and fought for the seller to pay to have the repairs made.  There was a leak and they agreed to fix everything except to replace the drywall that needed to be replaced due to water damage.  It was $500 worth of repairs.  What a headache.  The buyers just accepted it to just to move forward.  The buyer's agent was not very eager to go back to the listing agent to try to at least get them a credit to take care of the cost of taking on the fix.  Oh well.

Hi Nestor and Katerina!  That would have been my next step but the clients called me today to let me know that they were just going to move forward and were done trying to get her to "work" for them.  That is unfortunate.  But I am glad that everything is moving along again.  They have already referred one of their neighbors to me and I will be listing their house next week.

Hi Ann!  My representation of them for selling their home will earn me referrals.  That is all that is important.  They know that not all agents are alike now if they didn't before.  

Hi David!  They think that we should do everything that we can for them even if we aren't getting paid for our knowledge and expertise.  They just don't understand that we get paid based on that knowledge and experience.  It is valuable and not a free commodity.  Or at least it shouldn't be and isn't for me~

I am sure they are frustrated and probably don't fully understand how things work;  it puts you in an awkward situation, for sure, but you cannot interfere with that other relationship.  It is quite a compliment to you, though!
