New Hampshire Real Estate Commission /Statute & Code of Administrative rules ; 331-A:10-a Criminal Records Check.
I.All applicants for a new salesperson or broker license shall submit to the New Hampshire department of safety, division of state police, a notarized criminal record release authorization form, along with the appropriate fee, prior to submitting an application for a real estate license.
II. The (real estate) Commission shall supply the criminal record release authorization form to new salespersons and broker applicants.
III. Upon receipt of an applicant's criminal record information, the commission shall make a determination of eligibility for licensure. Source 2005, 286:8 Effective July 1st 2005
In an other recent addition to the state law, it was enacted under RSA 331-A:34 Penalty
Any person acting as a real estate broker or real estate salesperson, without a license shall be guilty of a class A misdemeanor if a natural person, or guilty of a felony if any other person Source. 1993, 348:1/ 2005, 206:2 & 2006, 98:2 effective July 8 2006

I choose to make reference to the Criminal background check and penalties for practicing without a license to emphasize to persons wishing to take advantage of unsuspecting consumers the laws are getting tougher and scam artist need not apply to our industry. Has other states taken similar positions in light of consumer concerns I would like to hear other brokers feed back on this subject??
