I don’t like how the seller countered our offer

 

A newer agent in our office came to me the other day asking why an offer they made for their buyers on a property that received multiple offers wouldn’t counter their offer with the price they desired. The property in question is in a desirable area and has received lots of attention and it’s not surprising they received numerous offers.

 

The seller has a right to accept, reject or counter offers they receive. The seller in this case opted to use a form promulgated by the Texas Real Estate Commission which is used by Texas REALTORS and their clients….it’s called a “Seller’s Invitation to Buyer to Submit New Offer” (we have a form or an addendum for everything). This is an acceptable counter from a seller and buyers need to understand if they want the home they must decide how much they want the home! It would be advisable to submit quickly because the seller can continue to market the property to others buyers and continue to accept offers.

 

Remember the seller and their agent is trying to obtain the highest and best price. In a market where the inventory is low and the demand high it is a seller’s market and this form is utilized more frequently. If you’re a buyer in this type of market you need to give it your best shot if you hope to win the bid.

The sellers do not have to do any negotiating and in the case of multiple offers, higher than the price selection and other factors come into the eenie meenie miney moe. Buyer may not like the competition of others at the property buyer lunch counter, but as long as the ground rules are spelled out. About make it one time,  your highest and best, consider all the ingredients from down payment size, time frame to close and easy does... make it weight watchers, high school skinny on the degree of contingency weight, add ons. They had the option to go over the top to secure the sale. Or they walked and wait for another property listing to come by that they wolf whistle, chase down

No matter how strong a market is, I've found that many home buyers still think they can bargain their way into a home and that a seller needs to dance to their tune. Not so.... and in multiple offer, forget about it!

Dorie I do love that form!  Like you, I have had many mixed reactions to it.  It is even worded nicely - "Invitation" rather than "REJECTION"!

In this market buyers need to be prepared to make their best offer up front, at least in most caases since you do not know if you will get a sescond chance, espeically in the case of multiple offer. It's good to know the process that can be invoked in your area so buyers, and sellers, understand how it all works and there are no surprises. No doubt clients will be pleased to have this all explaind to them

Seller's Invitation to Buyer to Submit a New Offer.  I just about fell out of my chair as that's the best title I've seen in a while for a form.  Nevertheless it's interesting how other market areas handle multiple offers, even in my area it seems that individual agents have taken a slightly different approach.

I guess that form would be better received that a reject to the offer.  just regroupand resubmit.   Nothing to it really if you want to stay in the game.

I love that form name; it's got that gentle Southern feeling to it (I know...Texas, but it's still sort so Southern, isn't it).

That's better than what we often see here in the Washington DC area which is either no counter, or a full priced counter.  Both of those responses are more in-your-face. 

I'm going to smile for the next few weeks when this situation comes up, and I'll wish I had the "Invitation" Addendum.

Interesting form. Here they just call for highest and best offer. Listing agent usually sends an email. First with the most is the winner most times.

We are often asked for our best and final offer when there are multiple offers. The seller never names the price they want (maybe they'll get more!)

We have a similar form in NC.  Its purpose is to allow the seller to respond without making a counteroffer, so he can respond to several offers at once if he wants to.
