The first part of the year started out pretty quiet. That told me that something was brewing for sure. Sure enough, when it rains it sometimes pours. Now, I am busy with complaints coming before me as I sit on the professional standards hearing panel. Agent versus agent, broker vs broker, public versus all and no one is wrong?
WE HAVE A MELTDOWN
I have been doing this for years. One thing that stands out is the poor communications between the parties especially when they don't agree. Instead of upping the communications, problem solving and expanding on the different points of view, a total breakdown occurs. Then, many make it worse. Its like falling into a 3 foot hole and panicking making it into a 6 foot hole. More work to get out of!

I'LL GET EVEN WITH YOU
Instead, grievances are filed, blame goes wild, and I sit and hear how each person explains to me how the OTHER person violated the rules of conduct and procedures. Rarely do I hear accountability or responsibility which is simply one responding and accounting for their own actions. They are wrong and out of line? You ever danced the Tango alone? It usually takes two to tango.
DON'T SELL ME...TELL ME
I notice that during procedures, when someone is trying to sell me a bill of goods which is exactly what led to them being in this room and before me; When I am not buying it, they start repeating themselves and if I don't bite then, they object or argue over my questions and comments. Now, the panel is wrong?
SELF-EVIDENT HAS THE FINAL WORD
It is then that everyone in the room gets to see how that person got into this room to begin with. At some point, I often wonder where is the Broker, mentor or associate that this person can consult with and make the different choices other than radical dispute resolution. Why cant you see what I see before you see me? Get the picture?
I ACCUSE YOU OF ALL VIOLATIONS OF THE ETHICS CODE
Another thing that stands out is how everything is blown out of proportion which leads to additional problems and finally a mess that has to be arbitrated, decided upon or even assessed for disciplinary action. Its like hydration in a human being. You are supposed to drink before you are thirsty. When you thirst, it is too late. Same with behavior that leads to trouble. Check it before it goes any farther
PROBLEM then SOLUTION
Deal with issues that come up while they are tiny and handle-able and they wont reach epic proportions that require drastic attentions. I may seem a little harsh in my commentary but it is no accident that I do so. What is being disputed today really is the lack of professionals and their experience and when those personal and professional chickens come home to roost....I'll be waiting
I now call this hearing to order....
