No longer will the hands of banks and private owners be tied and subject to injustice in regards to invaders entering into a residential property and being able to stay there without fear or consequences. Squatters, trespassers and home invaders regardless of their tactics have finally been check-mated
WHAT THE HECK TOOK SO LONG?
This has been a huge problem in the Real Estate industry for decades especially during and after the most recent devastating Real Estate crash. I am sure everyone remembers the oft used saying..."possession is nine tenths of the law" meaning whoever is in possession, rules the roost. Well its true!
THIS BOGGLES THE BUSINESS MIND
Crafty Homeless people, opportunists and gangs were able to seize a property by breaking into it and then staying there. It didn't matter what the owner, bank or neighbor said. The people in the residence now had rights. Remember, they broke in to begin with either by smashing a window or changing the locks. That doesn't matter. WHY? They are now in possession! They have rights! it boggles the mind!
OUR LEGAL SYSTEM WAS INEFFECTIVE
This became very lucrative to many when cash for keys was making the rounds. The bank, investors or private parties would pay people to GET OUT of the home so they could take possession of it. Word quickly spread on how you could make thousands of dollars and live rent free too! The alternative, our legal system was too costly and time consuming. Imagine that!
POLICE TO THE RESCUE RIGHT AWAY
When a home becomes immediately vacant, posting a declaration of ownership with local law agencies which registers the property as vacant is now allowed. Then, upon inspection by the bank or owners, if there is a squatter, police go over and take quick action...
LORD OF THE LAND?
What prompted all this? Well properties were being kept off the market, away from the true owners and being damaged in the process. The law of the land in regards to Real Estate is you as owner are literally Lord over your land able to do as you wish. Criminals and opportunists sabotaged that concept
CREATIVE LYING?
Furthermore, when renters had moved out, squatters moved in and by not being able to be evicted and by not paying rent, owners lost control of their own property and many went into foreclosure as well. They cant sell it or rent it. You see many squatters would produce fake leases or use the latest tactics of they were duped in a rental scam.
THIS WAY PLEASE
Without this new law, it could take months to years depending on circumstances to evict a trespasser or squatter. Now, one call to the police and its bye bye and no stories, counter arguments or claims will be allowed. Talk as you walk...OFF the property. Keep moving to the sidewalk and don't come back!
There oughta be law was said with hopeless breath...Now there is!
