Hammock Dunes Luxury Home Built on Wrong Lot - Joyce Marsh Homes BlogFlagler County - Ocean Hammock in Hammock Dunes  - A Luxury ocean view dream home in beautiful Hammock Dunes, a high end gated master planned community in Palm Coast was actually constructed on the wrong lot.  The mistake was not discovered until recently, six months after receiving the Certificate of Occupancy when a surveyor, who was doing a survey on the same street, discovered the error and notified the community manager and builder.

The 3-story vacation home,  with an estimated construction value of $680,000 actually sits on the lot next door to the one it was supposed to be built on. 

The builder, Keystone Homes (a highly respected builder) was hired to construct the home for the Voss's of central Missouri on one of the 18 lots the Voss's purchased in the community.  As it turned out, Keystone actually built the home on the lot next door which was mistakenly tagged and surveyed with the incorrect information owned by the Massaro's from North Carolina who purchased their lot in 2003.

Keystone Homes has contacted the two lot owners and other parties involved and is trying to negotiate a settlement.  The preliminary plat, foundation, and final survey all indicate that the 5300 SF home with 5 bedrooms and 5.5 baths sits on the correct lot.  Flagler County delivered a Certificate of Occupancy in March.  A title insurance policy was issued for #23 Ocean Ridge Blvd, but the house sits on #21 Ocean Ridge Blvd. North.  The 5,300 square foot home is in the gated Ocean Hammock resort community of Hammock Dunes in Palm Coast and everyone, from the land surveyor, construction firm, utility companies and Flagler County building inspectors missed the crucial mistake.

It wasn't until September, six months after the Voss's house was completed, that the survey crew uncovered the error.  

Attorneys are now involved and all parties are trying to work towards a settlement.

Hopefully the lawful owner of the lot will not try and take extreme measures and be able to settle without creating financial ruin. The way it sounds, it could have happened to any of those adjoining lot owners.

I don't know how could that happen when you have to secure all these requirement and certifications  before you get started building a house. But anyway, that's right, we would love to know an update how this problem was settled.

Joyce Marsh, Central Florida Real Estate this is awful just awful .... this happened  to a client of mine we were trying to sell her lot I kept calling her saying I think someone built on your lot. Her response was oh no that can not be but guess what it sure did happen. My stomach ached when I had to walk up to the person that built on the wrong lot and ask questions did you get a survey did you get a title policy did you work with an attorney in your purchase.... The answers were all NO oh my my stomach ached ... He was not a happy camper when he realized what had happened. All parties talked to attorneys and the seller of the lots he built on said we can trade lots you pay all the expense and we will just trade lots... Now how cool is that to be so nice and helpful about the fact of the mistake ... some would not be so nice. I wish you all the best in this and hopefully they can just trade lots.
