Jenna's post reminded me of the first time I attended a Fair Housing seminar. 

The room was packed with agents cramming their CE 3 Fair Housing hours.  Of course, Fair Housing is mandatory.

The gentleman, an official in the Fair Housing office in Maryland, was one of the best speakers I can remember.  The room was captivated.  Probably the first and last time the subject of Fair Housing held many agents' interest.

We got to the end of his presentation and it was time for questions.

One lady Realtor asked, "What happens to a Realtor if a Fair Housing complaint is filed against them".

His answer was very telling and persuasive.  He just slowly grinned and said,

"They're MINE".

"Just talk about the house!"  I remember this phrase very clearly from my early real estate training. The Fair Housing Act is covered pretty extensively in pre-license courses and most brokerages offer refresher CE classes from time to time.  

This afternoon, I was looking at some listings that I want to preview and noticed a few words and phrasesEqual Housing Opportunity in the public remarks that stuck out.  And not in a good way...

"Family home"

"Great for single or couple"

"Exclusive"

This isn't a lesson in the Fair Housing Act and I am not holding myself out as an expert by any stretch nor am I implying that these words or phrases are in direct violation of the Act.  

Very few words and phrases are SPECIFICALLY listed as forbidden, but in my opinion, when it comes to Fair Housing, BETTER SAFE THAN SORRY!

Avoid the appearance of impropriety and
JUST TALK ABOUT THE HOUSE.

That is one topic to avoid. Besides, it is simple to avoid. Fair housing should be so ingrained in us from day one.

John.  Sadly, it's more than an inconvenience.  HUD operates on the theory that you're guilty unless you can prove your innocence.  The minimum fine is $50,000.

Gary.  You'd think it was.  Sadly, there are still folks who don't understand Fair Housing because they discriminate.  I've not met any in VA, but did a number in Maryland.

When I am writing a descriptive marketing blurb for any property,  I read it over and over to make sure that it meets the guidelines without any grey area.

Jane.  I'm sure you would have enjoyed it.  He made Fair Housing interesting. 

That said, I never forgot the intent of his talk.  When that lady asked that question, many of us just shrugged our shoulders.  Good grief, where had she been for the past 3 hours???

Sheri.  That is absolutely necessary.

George.  Oh, I don't believe so.  The CFPB serves no useful purpose as nearly as I can determine beyond providing jobs for some government clerkels.

The Fair Housing officer was educating agents about something that many had given lip service.

Thanks for sharing this re-blog, Lenn Harley .  I had not seen the original posting.  Definitely a good reminder that we must all, whether agent or Lender, remain very aware of current rules and regulations about advertising and marketing.  They ARE watching ...

Lenn- it really makes a difference when you have a speaker who can hold your attention.  We used to run into similar situations when I placed office support staff.  The good old boys used to try to tell us exactly whom to send but we had to gently explain that we sent qualified applicants regardless of yada yada.   I didn't care to deal with companies who thought otherwise.
