I am really mad! (see my earlier post http://activerain.com/blogsview/454845/Mad-as-H-L) I was getting ready to send some listings to a buyer client today.  When I pulled up the list I decided not just to look at the listings but I also went ahead and looked at some of the tours.

 

Does your MLS allow agent to put personal contact info on their tours?

 

Isn't it pretty universal as a part of the IDX sharing that we can't have our personal branding or contact info on the tours? As a part of the rules for FMLS this is definitely the case.  Anyway, of the 23 listings that I pulled up 4 of them had the agent contact info either branded on them or available with a contact button!

I was on fire! So I did another larger search and pulled up about 150 homes in the local area.  I found about 10-15 more!  Every agent that has their buyers on any kind of auto listing email is letting their buyer get solicited by the listing agent!

Some of these might have been newbies and not known any better but I know some of them were brokers or broker associates who should absolutely know better. I am pretty sure that one of the agents I found today was a repeat offender.

I'm not about to names any agents or company names but I did see some common threads. 

It was almost always on agent created tours.  If the tours were provided by a third party vendor, the vendor knows the rules and there was no problem.  The two sources for tour hosting were either IMPREV or Point2agent tours.  Both of those companies do appear to have an MLS compliant version, because I saw those as well.

Listen up agents (at least those of you that these rules apply to) when you put your listing in the MLS for me to send to my buyers don't put your info on there so you can in turn steal my buyers!

I am at the point where I just start to report such things. Nothing personal. Rules are rules and.... I wouldn't forward those listings -- and cc the board and their broker, my broker in my letter to them letting them know.

If you want to be considered a professional -- act like one and educate yourself --- this is business for goodness sake. Everybody always giving excuses.

I had a rough day too -- can you tell?

This is a violation of our MLS rules and regulations. Our MLS has a report a violation button to have the listings corrected. Agents need to remember that while they are trying to gain an advantage, they are destroying their reputation within the agent community.

Jim and Paricia, Thanks for the comments. I did sendd them in to the ms and I think they took care of the ones that I found. 

The bigger picture is that I have a bunch of clients'prospects on auto searches and they get the listings before I can screen them.  There is now ay I can prevent my clients and prospects from being solicited by unscrupulous or unknowing listing agents.

I have created my own tours for a couple of years.  Another issue for me is that these other agents will cause the mls to change the rules and not allow us to post our own tours.  If we are forced to go o an "approved" third party vender that can be a significant expense.  Besides that I kind if enjoy the process of taking the pics myself and creating the tours.

Thaks for the comment. Who is your mls provider?  I really like the idea of a report violation button.  It would make it much easier for us to police each other.

Our MLS would just not allow it. The agents would not be able to post their tour if it had their personal info. Did you report them to your MLS?

Funny how my attitudes have changed toward reporting other agents.  When the report violation buttons first started appearing I felt uncomfortable about reporting other agents. Now, if I see a brazen violation I have no problem.  I wish that they had a report loan fraud button during its height so that I could have gotten rid of some of them.

My MLS just went to not allowing this, and I AM in compliance. But I can't help wondering WHY AGENTS CARE! So what's the big deal?

Hi Bob,

I just read your posting now. You are angry ...well get in line. It is a very dirty business and I can not believe really how people get away with it. you are  right and who ever did it  doesn't want to share, as you know, I think now we can call this market a buyers market so they come up with any thing to keep the total commission.
