New requirement for New York State landlords: sprinkler disclosure

A new law became effective December 3, 2014 in New York State.  This law requires landlords to include a disclosure in a rental lease about the sprinkler system status of an apartment.  This covers  not only landlords of large apartment type buildings, but landlords of one and two family rental property as well. The law is relevant for leases, sub-leases, renewal contracts and renewal leases.

 

A few specifics regarding the new requirement.  The print in the lease must be in bold. The specific requirement of the landlord is to include language that states whether there is or is not a sprinkler system installed at the time of the lease signing.

 

At this time, there is no requirement that a sprinkler system be installed if there isn't already one in place, and there is no penalty in place for landlord non-compliancy with the new rule (yet). However, going forward, all new leases should include language that covers the sprinkler system status.

Hmmm...they made a law with no teeth to enforce it?  Wonder how many people shrug that off until there IS some kind of penalty.  Sounds like a good law, though, disclosure of safety features is very relevant to tenants.

I am not saying this is a bad thing but its kind of like a seat belt in my opinion. Driving without one will not kill you but wearing one could benefit you in the event of an accident. I am guessing NY has about what 200 pages to complete a mortgage transaction with the endless sea of disclosures out there??? wow

No end to the rules that they will heap on the backs of landlords.

John Meussner the teeth of the law is that now you will look even more attractive to a tort lawyer should the home burn down, landlords will take it seriously even without a fine involved.

I do think it should be part of today's building code, but this seems a bit overkill for older buildings.

Bob - I think you're right; landlords will take this seriously.

Tammy - The sprinklers don't have to be installed; just disclosed. Although if I were a landlord, I'd probably want to install them to give me an edge over other locations.

Michael - I dont' think we're the first state to require disclosure, but I could be wrong.
