FOOL AGENCY OR DUAL AGENCY?

There are doctors that can generally treat and then there are doctors that are specialists in their field. A specialist is one that spends a a focused amount of time in a particular field of practice or activity. Dual agency is not your everyday type transaction but it definitely comes under the Real Estate license "can perform" type duties in California

NO THANKS

In life, it one is not comfortable in anything they are doing or asked to do, the rule is NOT to do it. Some people offer an explanation but one is really not necessary. I have turned down opportunities that I assessed to be not for me for whatever reason. Why... is not important if I don't take the assignment!

YES WE CAN

Being able to effectively and objectively represent two parties while protecting their common interest and outcomes is doable. It does help to have the necessary skills bank that allows this to take place. Add confidence, goodwill, honesty and transparency, a certain outcome is predictable. Dual Agency...Yes!

THE IMPASSE

Not everyone knows how to deal with an impasse. That is where it breaks down and becomes dicey when two people who have their minds made up meet head-on each one believing that this could be the deal-killer when in fact it is far from it. There is always a compromise or a solution floating around. An impasse signals us to find it...that's all! Then, we go from there...

NEGOTIATIONS

Negotiations are another dynamic where many people lack the savvy or clear thinking to present, keep track and examine the give and take of a deal and assign a value to it. The moving energy or factor is always going to be to help get the "wish lists" to come out. From there, it begins....

WIN-WIN

Being able to reach a win-win position is the crucial first step. There is no wanting to turn back at this point. WHY? If done right, it is revealed that the deal has legs and can travel toward the promised land. Helping all see how they are in a NO LOSE situation helps this along. I tell you where the sensitive areas are found...

WIN-PLUS PLUS?

It is when one person wants their win to be a win-plus (and more) which is fine as long as we all agree to it. If not, killing a deal because one person couldn't have it all won't prevail and is not supportable by anyone and most people know this. My way or the highway doesn't produce well now a days. The prices and players involved command more respect than that...

EMOTIONS...THE UGLY

One of the biggest factors of derailment is "wild" emotions. Without fail, they cloud the issues, make more out of nothing and invites more problems to join the existing fray.

EMOTIONS...THE GOOD

Staying focused, objective and proceeding with a method instead of a madness keeps everyone cool, calm and realistic. Wanting a property to purchase is an emotional driven dynamic and that is treated as a type of skin in the game...a good thing. Wanting to sell is another good one too

EMOTIONS...THE BAD

Employing "he who has the gold rules" by being stubborn when being agreeable will get you more is going in the wrong direction. Employing unreasonable forces when reason is required will cost you. Compromise is a food for winners! We want to bring out the "spirit of the deal" as well as the obvious too

TIT FOR TAT...THIS OR THAT?

Now, let me do the real math. It's can be a lot of work to maintain, nurture and communicate the various situations and items that come up for review and discussion especially when concessions are involved. People keep score that way. If someone gave in, then their math says the other party is due to give in. The "value" on the 'give' as well as the good will should be assessed and considered

THE BIG PICTURE

However, its the whole deal we are looking at and the give and take of it all. Makes one wonder that if a licensed Real Estate agent cannot handle this who can? Granted that it requires a literal hands-on focus, however it is our job when presented. My approach is to simply sit down with everyone and begin....

FOOL AGENCY

What do you want followed by how bad do you want it gets us started toward the promised land. Anyone who takes this on who is not experienced, who doesn't have the ability to finish what they have started and cannot communicate or reason should pass and wisely so less than end up with a fool agency. All parties will suffer.

Those that can rise to the occasion, can log another dual agency deal NOTCH...on their belts
