Countrywide, Thank You For Cancelling The Foreclosure Sale!

We did it! Oh, to make that call to our seller tonight was the best call I made today. The 11th Hour Save!

Our attorney was calling CW's attorney all day today and when he finally reached them the attorney told him that they would gladly cancel the foreclosure sale in the morning as long as Countrywide sends him a letter or an email giving him permission to do so. Here it the post that led to this post.

We spend all day praying and staying on the phone with our attorney and Countrywide. I would get off the phone with our attorney and then tell Nestor the update. Nestor would then get back on the phone with Countrywide and stay on the phone until the front lines at CW did all that they could do.

Nestor is the greatest! He is SO tenacious and would not get off that phone until he knew that the chain of command was followed all the way up with emails and phone messages from the front line. I am SO proud of Nestor not because I am his wife but because he did not give up. He stayed the course and remained very calm yet strong. Our buyers' agent Doug was over here at the time and was able to witness Nestor's negotiating skills. I was picking up my son from a homeschool event.

I prayed all the way home in my car and wondered why Nestor had not called me to give me the news since it was 5:00 when I was driving home and then I said, "God, the reason he is not calling me is because he is on the phone with Countrywide." And I was right! Nestor and Doug looked at me when I walked in the door and tried to make a joke that the sale was moving forward but then I saw Nestor smile! YEAH! I was jumping up and down and Nestor had a HUGE smile on his face!

The Countrywide Front line people were absolutely wonderful today. Nestor complimented them too and is writing a letter of commendation for them. They were really caring that our seller was going to lose her house tomorrow morning. The person that Nestor was talking to really wanted to help and went above and beyond what he had to do in order to get this situation resolved. But the negotiators were all passing the buck, they were not being responsive to any of the frontlines pleas for help. CW really needs to get some negotiators in there who know how to do this job. Nestor says these front line people would be better. They kept helping him climb up higher in the chain of command.

When there was 1/2 hour left before the CW attorney here on the east coast was going to call it a day Nestor finally was able to get through to the VP's office over this department. Someone representing the VP told Nestor that she was cancelling the sale since we had an offer on the house. In order to protect our seller's privacy right now we can not disclose the details of the entire conversation but suffice it to say, Nestor sprang into action and had it all solved within 5 minutes.

Then the VP's office called us back and said that she actually talked with their attorney, that we did not have to show up for the sale tomorrow and that we could all rest easy now! How nice of her to do that!

Note: Active Rain's server was down when I tried to post this last night. So I am not going back through the whole post and change all the today's to yesterday's, etc. But it all happened yesterday and last night FYI.

Katerina, you explained how you used your Attorney to assist you with your negotiations. Do you have a flat fee set up for the use of your Attorney on your short sales and list it on your HUD and if so, what exactly does he/she provide? Thank you.
