In a Massachusetts Supreme Judicial Court decision on June 3, 2015. The SJC decision upheld the ability of Real Estate licensee's to choose to affiliate as independent contractors or employees. That issue was brought to question in the case of Monell v. Boston Pads, LLC. You can read the synopsis in the link below. It is still wise to have a written independent contractor agreement stating your choice for that status.

I hope that will affect how NH looks at it too. Too many times they are looking for unemployment insurance and to add taxes and fees to brokers. Ill have to read the ruling later on.
