Contracts in Colorado

  • If a Buyer and a Seller want to draw up their own real estate contracts, they can do so.  But, a licensed Realtor in Colorado does not have authority to prepare contracts that have not been approved by the Real Estate Commisison.
  • All contracts for the sale of real estate in Colorado are required to be in writing to be enforceable according to Colorado Real Estate Law.
  • Contracts must include basic elements to be enforceable:  mutual agreement, lawful objective, and consideration.
