Wow!!! Opinions Needed, Deal or No Deal?

I received a Phone Call from a Friend asking for information on a Property.  I asked for the Property information, did a Market Analysis and told my Friend the Market Activity recent Solds, Actives, and Value of the Area.

My Friend explained that they are currently in Escrow, and is Dissatisfied with the Agent who is Representing Both Parties (Dual Agency), and can I Represent them.

The Comps for this Property says it's overpriced by $75k - $90k the Subject Property is a 3 Bed 2 Bath 1400 Square feet No Upgrades Built Mid 90's $500k.  4 Bed 2 Baths with Complete Upgrades $450,000.  Of course Market Value includes what a Sellers will Sell for, and what a Buyer will Pay.

 

I contacted the Agent ,and conveyed my Friend concerns.  The Agent became unprofessional, and after

Shouting hung up.  30 minutes Later the Agent called back, asked me why?

 

The No return Calls, the Requested Comps. never received, and other Material Facts that wasn't given.

My Friend wants to Cancel the Escrow.

 

What would you do?

    Your friend obviously wants out of the dual agency situation. 

    Is he under a written agreement (Listing Contract or Buyer Broker Agreement) with that Broker/Dual Agent? 

     If he is under contract with that Broker, I would send him to a real estate attorney for legal advice on breaking any Contracts, or getting out of Escrow.

     Also, if you are a member of NAR, check the Code of Ethics to make sure that you are not interfering with another Broker's Client.  Even though the Friend contacted you, the other Broker might still file an ethics complaint with your Board or Association.

How come the friend called you after the fact now asking for advice? Did he not know you are in the same business? Comps don't always tell the story in a tight market. Case in point I recently sold a home for $229k, which appraised for 200k.
